FACT: Before the fearmongering ratchets up. NY’s new discovery law, like laws throughout the country, allows for protective orders. The judge in this case was under *no obligation* to release witness information. This tragedy has nothing to do w/ the law. newsday.com/long-island/cr…
There are a lot of troubling questions about this case that demand answers. The answers will not bode well for Nassau County Police Commissioner Patrick Ryder (@NassauCountyPD) or Nassau County DA (@madelinesingas). One thing I know for sure: Discovery law is not to blame.
@NassauCountyPD @madelinesingas Question: Did the Nassau County DA's office request a protective order to hide the deceased witness's contact information from the defense under the old & new discovery laws? If they did, I cannot imagine any judge in the world ordering disclosure of the witness's information.
@NassauCountyPD @madelinesingas Here is a portion of judge's decision in a recent case of mine issuing a protective order requested by prosecutors. Blocked disclosure of witness information under the discovery law in a far less serious case. Notice the considerations judges must take into account under the law.
@NassauCountyPD @madelinesingas 2. If @NassauDA did in fact ask for a protective order & the judge denied the request, why? What reasons did the judge offer for refusing to withhold information in this case? Again, I can't imagine any judge doing so. But the old bail law & new bail law allowed for withholding.
@NassauCountyPD @madelinesingas @NassauDA 3. The @Newsday article mentions "a pattern of intimidation" that began on January 6, 2020 shortly after disclosure of the witness's information. What actions, if any, did DA @madelinesingas or @NassauPD take to protect the witness from that point until his murder?
@NassauCountyPD @madelinesingas @NassauDA @Newsday @NassauPD 4. For how long did the @NassauCountyPD & @NassauDA know about the tragic killing before going public with it? When did they learn about it? Did they Police Commissioner & Nassau County DA coordinate stories, media strategy, & anti-discovery talking points before announcing it?
@NassauCountyPD @madelinesingas @NassauDA @Newsday @NassauPD The @NassauCountyPD Police Commissioner told Newsday: "This man's dead bc we didn't do enough." The discovery law isn't to blame. We know that. Witness info is explicitly protected.

Did @NassauDA request a protective order?
