After yesterday when the court had asked the police to take a decision on filing the FIR for hate speech, the Delhi Police through the SG filed an affidavit stating they have decided taken a decision to defer taking a decision.
The SG submitted that FIRs for hate speech are not important and that FIRs relating to arson etc have been registered. This submission is directly against the law laid down by the SC. The SG has essentially given a new jurisprudence in crim law, by giving a hierarchy to offences
The law if anyone was bothered with things like those is that if a cognizable offence is committed, the Police MUST register an FIR. there isn't an option available. There exists no hierarchy in criminal jurisprudence.
The court has completely chosen to disregard the law, laid down by the SC and has granted time to the Hon'ble SG to file a detailed reply in 4 weeks and adjourned matter to April 13.
Today, I feel ashamed to be a part of this profession and this system. #bye
