Judge Abhay Thipsay joined Congress in 2018 after his retirement, had convicted 9 out of 17 accused in Best Bakery case in Feb 2006 despite no credible proof. Thipsay claimed that Hindus carried out the 2008 Malegaon blasts when nothing is proven yet esakal.com/saptarang/form… (1)
Thipsay was present at launch of book “Brahminists bombed, Muslims hanged” by known liar & ex Police officer Mushrif in Pune in Aug 2019. Mushrif earlier claimed Karkare was killed by radical Hindus. Thipsay said we should accept Hindu organizations carry out bomb blasts. (2)
Author Mushrif went to d extent of implying that Muslims were wrongly blamed for d July 2006 Mumbai local train blasts, which killed 187 people & by extension, that those blasts were done by ‘Brahminists’ since the title of his book was ‘Brahminists bombed, Muslims hanged’. (3)
Mushrif implied that Brahminists did the 2010 German Bakery blast in Pune when a little-known jihadi organization had claimed responsibility for the same. thehindu.com/news/national/… Indian Mujahideen terrorist Yasin Bhatkal is an accused in the case and is facing trial in it. (4)
Mushrif alleged that the 2014 Pharaskhana bomb blast was done by Hindu radicals & not Islamists, which was strongly refuted by the IO, who called Mushrif’s allegations as ‘baseless’ & said that the correct procedure was followed in the investigation indianexpress.com/article/cities… (5)
Justice Abhay Thipsay was present at the launch of such a book by such a man Mushrif! His act after his retirement of joining Congress, & launching such a book has shown how his judgments (eg on Best Bakery case) were affected by biases. Ex-CJI Gogoi has not joined BJP. (6)
Mumbai HC acquitted 5 out of 9 convicted by Thipsay, said that no witness had identified them as part of mob that attacked. Then how could Thipsay convict them on 24 Feb 2006 except for a huge bias? In his court only 1 unreliable witness had accused them, who later retracted (7)
In July 2012 the Mumbai HC condemned Abhay Thipsay’s comments as trial court judge of Feb 2006 against the defence’s lawyers in Best Bakery case. Mumbai HC gave them a clean chit calling the lower court’s observations against them as “uncalled for” ndtv.com/india-news/bes… (8)
Even Mumbai HC which convicted 4 in Best Bakery case in July 2012 relied on testimony of 4 witnesses who had CONTRADICTIONS in their statements, said that the contradictions be DISCARDED, while accused should be given benefit of doubt in such a case indiatoday.in/india/north/st… (9)
If the accused were indeed guilty, why should there have been contradictions in statements of witnesses? But even this Mumbai HC acquitted 5 accused against whom no one made any charges, but Abhay Thipsay had convicted them, just for the sake of getting some convictions. (10)
The SC acted exactly as the National Human Rights Commission pleaded in many cases on Gujarat riots issues since 2003. The then NHRC chief, A.S. Anand was a recently retired CJI indiatoday.in/magazine/state… The then sitting SC judges were his personal friends & ex-colleagues. (11)
The then CJI, V.N. Khare, Justice Arijit Pasayat and others were all erstwhile colleagues of the then NHRC Chief A S Anand. And Justice V.N. Khare and the other judges passed exactly the same orders which the NHRC wanted them to pass in many cases on the Gujarat riots issues (12)
The then CJI, V.N.Khare was an allegedly Indira Gandhi-appointed judge (of Allahabad HC, appointed on 25 June 1983). As an Advocate in 1975, Khare and his uncle, S.C. Khare, represented Indira Gandhi, the then Prime Minister, in her famous case against Raj Narain. (13)
The then CJI V N Khare was responsible for advocating the case that got the order of the Allahabad HC stayed until an appeal could be filed in SC. The adverse & ambiguous decision of the SC led to the imposition of Emergency in India for a period of 19 months from 1975-1977 (14)
When he retired in 2004 Khare said, “I found there was complete collusion between accused & prosecution in Gujarat, throwing rule of law to the winds. SC had to step in to break the collusion to ensure protection to the victims and the witnesses." hindu.com/2004/05/02/sto… (15)
In interviews to media in 2004, V N Khare explained why he decided to transfer the Best Bakery case to Maharashtra for a retrial telegraphindia.com/india/khare-vo… & rediff.com/news/2004/may/… Now we understand why it was transferred to Abhay Thipsay, who was going to forcibly convict! (16)
In 2012, Khare revealed that he believed 2002 Gujarat riots was an instance of “state sponsored genocide” hardnewsmedia.com/2012/02/4566 when it was neither state-sponsored nor ‘genocide’ as 100s of Hindus were also killed by Muslims in Gujarat in 2002 & 40,000 Hindus were homeless(17)
Khare went to the extent of saying in 2012 that ‘I would have lodged an FIR against Narendra Modi on charges of genocide and manslaughter’. hardnewsmedia.com/2012/02/4566 After his retirement, Khare openly revealed his opinion against Modi & Gujarat Govt. No outrage at his bias? (18)
Jyotsna Yagnik who convicted Maya Kodnani was once a junior lawyer of Gujarat Cong leader & ex-Acting Speaker of Assembly Manubhai Palkhiwala biasedjudges.blogspot.com/2013/08/biased… & principal of I M Nanavati Law College in Ahmedabad which was owned and managed by a known Congress family (19)
In the SC there was a bench of Aftab Alam & Ranjana Desai which not only passed orders against Gujarat Govt but also made several unnecessary comments against it. Ranjana Desai is daughter-in-law of former Congress Minister of Gujarat, Amul Desai. timesofindia.indiatimes.com/city/mumbai/Ra… (20)
Aftab Alam was so biased that a former Gujarat Lokayukta wrote to the then CJI Justice Kapadia to keep him away from the Gujarat Government cases. articles.timesofindia.indiatimes.com/2012-07-27/ahm… Aftab Alam’s daughter Shahrukh Alam is also a known anti-Modi activist, linked to Teesta Setalvad. (21)
The Gujarat High Court judge who saw the Ishrat Jahan case was Justice Abhilasha Kumari, daughter of the then Himachal Pradesh CM Virbhadra Singh of the Congress Party! The 'secular-liberals' were gloating with joy when these people were judges. Now suddenly condemn Gogoi! (22)
Judgments given by ex-CJI Gogoi were of benches with 5 or 3 judges. But Thipsay was sole judge in Best Bakery case. Ranjana Desai & Aftab Alam together were one bench. Gogoi is NOMINATED RS member from 12 distinguished people. Total cover-up of biased anti-Modi judges (23)
To know far more details of Abhay Thipsay's dangerous judgments and biases, as well as of the then CJI V N Khare, read this article in full opindia.com/2019/08/all-yo… Thipsay openly joined Congress. Instead of condemning/questioning his judgments, they are condemning Gogoi! (24)
Many retired SC judges openly talked against Narendra Modi, many of whom like Justice Retd Krishna Iyer said that Modi should be prosecuted for murder. If such judges passed such horrible comments post-retirement, then what they must have done while they were sitting judges!(25)
Self-appointed CCT gave a report in 2002 holding Gujarat Govt culpable & made a fool of itself by absolving Muslims of d crime of Godhra, saying that the fire was ‘set from inside’ & ruled out that any mob torched d train. CCT team had many ex-judges rediff.com/election/2002/… (26)
The 9-member CCT was titularly headed by Justice (retd.) Krishna Iyer. Other members included Justice P.B.Sawant & Justice H Suresh. CCT report was full of lies & factual errors, which we will expose later. It demanded arrest & prosecution of Modi! rediff.com/election/2002/… (27)
These biased retired judges called the 2002 riots a ‘genocide’ ignoring 100s of Hindus killed & did not pin-point what Narendra Modi did wrong. They ignored all the steps taken to control & prevent the violence like 827 preventive arrests, etc! gujaratriots.com/index.php/2008… (28)
What impartiality can one expect from such judges like P B Sawant, H Suresh, Lone, Krishna Iyer, when they can go to d extent of whitewashing barbaric killers’ sins in Godhra & defending the indefensible and inhuman barbaric roasting of 59 men, women & children by Muslims? (29)
Retired SC judge UC Banerjee called d horrific #Godhra massacre an 'accident' without telling how so many stones were pelted on the train, how burning rags were thrown, & why Ram sewaks did not run out of the train if it there was not a mob preventing them from coming out (30)
Banerjee said that Muslims of Godhra had assembled there to put out the fire! This is like saying that Nirbhaya's killers went there to save her. Such a biased judge appointed by Lalu who gave his report on Lalu's order was not condemned, instead its Gogoi who is condemned! (31)
In a program in Nagpur on 17 Feb 2020, Justice Kolse Patil said that Karkare was killed by Hindutva-minded policemen, Col. Purohit plotted to kill RSS chief Mohan Bhagwat & that the late PM A B Vajpayee used to take women with him on every foreign tour. He was judge of HC! (32)
How easily Left ecosystem condemns ex-CJI Gogoi & decisions of SC (on Ayodhya, Rafale etc) without any fear of 'contempt of court'! swarajyamag.com/politics/barri… Decisions on Ayodhya, Rafale etc were made by multiple judge benches, not Gogoi alone. Expose real biased judges. (33)
