A DC federal court will hold a hearing this a.m. on whether an unnamed US citizen detained as an “enemy combatant” in Iraq can be “released” in Syria.

Although “John Doe” has been in US custody for 10 months, there’s still been no ruling as to the legality of his detention...
Last November, I wrote that Doe’s case was thus setting a dangerous precedent because it was allowing citizens to be held for 11 weeks without any such ruling:

Eight months later and still without a ruling, the precedent being set is even more dangerous.
Among (many) other things, it continues to befuddle me that this case—and the absence of a merits ruling from Judge Chutkan—hasn’t gotten more attention.

If it’s because Doe appears unsympathetic, how do we actually know that without a judicial ruling as to the facts and law?
