Breaking: The Department of Justice announces in a court filing this morning that it will be filing a "Statement of Interest" — similar to an amicus brief — in the pending Harvard affirmative action case. John Gore is the top signatory, so, here we go.
Here's the motion filed this morning, which asks to seal part of what it will be submitting due to an ongoing dispute over whether materials in the case should stay sealed: documentcloud.org/documents/4801…
In plain English: The lawsuit alleges that Harvard is discriminating against Asian-American applicants, and the US will be taking a position in that case today. We don't yet know what it is because they have not yet filed, BUT ...
John Gore, the acting head of the Civil Rights Division, has been spearheading the DOJ's own investigation into Harvard's admissions (and was behind the Census citizenship question move: propublica.org/article/john-g…). His is the top name on this morning's filing.
