House Judiciary has *quite* a federal courts bill on the agenda for Thursday: 52 new district judges, SCOTUS real time audio w/in 2 years; video streaming of all appeals court proceedings w/in 2 years, SCOTUS justices must explain recusals on website (!) judiciary.house.gov/wp-content/upl…
And there's another bill to add five more appeals court judges to the 9th Circuit and break it into four divisions (Northern, Middle, Southern and Circuit). judiciary.house.gov/wp-content/upl…
Those bills are in addition to this bill on limiting nationwide injunctions
I imagine all these bills would be... difficult... to get through the Senate.
These bills appear to add exactly what the U.S. Courts asked for in June uscourts.gov/news/2018/06/2…

Kavanaugh answers a question from @SenFeinstein about his use of the term "abortion-inducing drugs," which was tweeted about by Hillary Clinton and others. Only recounting plaintiff's assertions, he says.
Kavanaugh says his description of Roe v. Wade in a 2003 email was comments on the view of legal scholars, and "did not describe my own views."

The court did GVR 2 cases—grant, vacate, & remand—asking lower courts to reconsider a ruling in a case in light of a recent #SCOTUS decision. While the one GVR is based off of a decision issued last week, the Fleck GVR follows several conferences & the Janus decision from June.

#Khashoggi Case Thread: I am going to ‘pin’ this post to use it as an ‘Info Thread’ on the #Khashoggi Case. I am in #Turkey. I’ve been following the case closely and with access to sources & experts here. This is a very ‘sensitive’ criminal case due to ‘Diplomatic Booby Traps’!!!
The Evidence Obtained Outside Cameras will not show any evidence of ‘tempering’ but other than license plates of dozens of diplomatic cars (Many with tinted windows-large trunks) with related time stamp, drivers Info, model/year: Nothing.
#Turkish Intel-Investigative Bodies also have the list of all Diplomatic & Private Saudi & “other significant’ Planes in #Turkey for the period of ‘interest.’ Many of the Target airports have their own security cameras & related evidence.

Madison v. Alabama arguments were really interesting for reasons I’ll be writing about this afternoon, but as to the substance of the case, Alabama appeared to come across to the justices as having the weaker of the arguments, both procedurally and substantively.
An important caveat: Neither Thomas nor Gorsuch spoke, so we did get a tilted view at arguments of what the justices are thinking about here.

#SCOTUS has become powerful. But largely because we (our politics) have asked it, even required it to become so. We can take that power back - it starts with Congress not delegating away so much of its power through ambiguous statutes or statutes enforced through litigation. 1/
2/ but it also involves a recognition from public interest lawyers, social movements and their founders that #SCOTUS is neither a reliable nor safe alternative to the hard work of grassroots organizing, state by state strategies and lobbying. We have to get back to politics.
3/ now might be a good time to read some classics like Gerald Rosenberg’s “The Hollow Hope,” Gordon Silverstein’s “Law’s Allure” that illustrate the perils of choosing courts over legislatures to achieve policy aims.
