Thread about the brief we're awaiting by midnight — but still don't have — in Andrew Miller's appeal to his contempt order. He's challenging of Mueller's authority to subpoena him for the grand jury.

UPDATE: Miller's brief is in. It is dated 9/11, but "entered" at 12:01a 9/12. (I deleted the tweet saying it was not in.)

Per the DC Circuit's automated system, Miller's lawyer was about a minute and a half late. (Won't likely make a difference for Miller, technically, but the court knows and his lawyer has certainly not made a good showing these past few days.)
Sasha suggests Miller's lawyer might need to get another 90-second extension so that he will have filed in time.
In short, what a shitshow. And we've not even gotten to the argument yet.
So, yeah, the brief *definitely* does not comport with the court's rules.

Update: At 4:34a, Miller’s lawyer filed an “ERRATA,” with a (presumably) corrected version of his brief. Two minutes later, he also filed an Appendix. (I’ll upload them shortly.)
