JUST IN: We still haven't heard from #SCOTUS on the Census citizenship questionnaire case stay request — they're trying to stop depositions of Commerce Sec. Ross and DOJ's Gore — but we have a scheduling order from the trial court: documentcloud.org/documents/5007…
Basically, some pre-trial motions are to take place over the next week, trial-related amicus briefs are due by Oct. 29, and — should the Supreme Court allow them to go forward — the parties are to meet to schedule the depositions "immediately" after such an order from #SCOTUS.
Little correction from the court here: The letter motion re: live direct examination is due by tomorrow, not today.

BREAKING: Supreme Court denies the foreign country-owned company's request to stay a contempt order resulting from its refusal to comply with a grand jury's subpoena. Chief Justice Roberts' "administrative stay" is vacated, so the result is the contempt order is back in effect.
That order of the court follows this request, made Monday but put on the docket today, to file a cert petition in the case under seal. Not clear what will happen with that now, but the contempt order (and associated fines) will now be back in place.

#SCOTUS, Jan. 8, 2019. With most of the sights in DC shut down, the Supreme Court is drawing a big crowd even for relatively low-profile cases.
It's a one-box Tuesday here at #SCOTUS, meaning one or two decisions in argued cases should be coming at 10a.
The first decision is Justice Kavanaugh's first majority opinion, in Henry Schein, Inc. v Archer & White Sales, Inc., vacating the 5th Circuit in an arbitration case. The decision was unanimous. #SCOTUS

1. At risk of being one of many to wrongly predict what Mueller is up to, I make this observations based on circumstantial evidence in public record to report that I think something big is coming. First, past four days Trump is shuttered in the White House with just a cell phone.
2. Second, the #SCOTUS CJ Roberts ordered (we presume Mueller's Govt team) to respond to the secret Grand Jury case stay he granted by Dec. 31 at noon. They did it three days early. 3. Finally, case I'm watching at SCOTUS that I think may remove Whitaker as AAG is teed up to discuss in conference on January 11. I have reported extensively on this including detailed analysis of legislative history. IMO #SCOTUS must declare Whitaker to be former DOJ employee. Whitaker cert petition motion to declare not AG case docket.

NEWS: #SCOTUS greenlights nearly all discovery in @NewYorkStateAG & co's #2020Census case, except for Sec. Ross deposition which remains on hold pending further briefing (despite an inaccurate AP story that he “can’t be questioned,” period).
DOJ just filed another motion with the district court to stay @NewYorkStateAG’s #2020Census case ahead of our Nov 5 trial. That’s right - after asking #SCOTUS to stay discovery and losing, they’re trying again with the district court. Seriously.
In our latest filing with the district court, @NewYorkStateAG notes that FOURTEEN judges have thus far rejected DOJ’s efforts to halt her #Census2020 suit.

1. At the outset, thanks to everyone for their thoughtful engagement with my tweets evaluating the "perjury" claims against Kavanaugh, which I deeply appreciate (even -- or especially -- when folks disagree with me). Sorry I can't respond to all individually.
2. The Kavanaugh testimony being evaluated for truthfulness comes from his judicial confirmation hearings -- in 2004 and in 2006, for the D.C. Circuit, and last week, for #SCOTUS. One needs to keep this important fact in mind at all times.
