Thread: FL federal judge just held a hearing on Florida Dems' lawsuit challenging rejection of ballots with signature issues. Dems and FL Dept of State advocated for a ruling on a temp. restraining order by noon tomorrow, a key election deadline, but the judge questioned the need
At noon, counties provide unofficial counts, which are used to determine if there are recounts. Dems/Dept. of State said a ruling on whether rejected ballots should be included was preferable. But judge questioned urgency, saying he could still rule later to count the ballots
Lawyers for the Dems said it was possible the judge could craft an order after Saturday that would somehow address the inclusion of the rejected ballots in deciding the threshhold for a recount. The judge said he'd think it over, and also set a hearing for next Wednesday
Lawyer for FL Dept. of State said that if there was a later order to include the rejected ballots, counties would have to resubmit their tallies, and any recounts underway would have to stop and start over
Other business taken care of at today's hearing: The judge granted motions by the Florida AG's office and the National Republican Senatorial Committee. A lawyer for Ron DeSantis was on the line (it was a call-in hearing), but said they aren't going to formally enter the case

NEW: The federal judiciary now expects to have enough money from other sources to keep the courts largely business-as-usual during the shutdown through Jan. 18 (previously it was Jan. 11) — this is the latest from the Administrative Office of the US Courts (HT @hsu_spencer)
In order to make the funds that the judiciary does have (absent a congressional appropriation) last as long as possible, "courts have been asked to delay or defer non-mission critical expenses, such as new hires, non-case related travel, and certain contracts"
DOJ, of course, is already affected by the shutdown, so most judges have been approving requests or issuing blanket orders to delay civil litigation involving the federal govt during the shutodwn (criminal cases still have to proceed as usual)

Some fireworks in court this morning as a judge criticized the lawyer representing Concord Management & Consulting in the special counsel Russian troll farm case for his language and harsh words about Mueller's office in filings — "unprofessional, inappropriate, and ineffective"
The judge told attorney Eric Dubelier that his strategy was "ineffective" and that his approach to filings — including pop culture quotes (see: assets.documentcloud.org/documents/5676…) and accusing Mueller's office basically of lawlessness — was "undermining your credibility in this courthouse"
"Knock it off," Judge Dabney Friedrich told Dubelier. This then led to a heated exchange where Dubelier said he needed to consult his client since the judge had accused of unprofessional conduct, and now there might be bias from the judge. There's no bias, the judge replied.

Folks: Few states count provisional ballots, early ballots, or overseas ballots quickly; usually they do not have to do so because the numbers don't require it... there is a big enough margin for these not to have any effect. In #Florida and #Georgia you have several issues. 1/
@ScottforFlorida has been governor for two terms/8 years. During this time he has underfunded election security and election processes, did not replace Ms. Snipes who he now berates. Why? So he could underfund the election machinery in that county and then blame her for problems?
For @ScottforFlorida to complain now when he is responsible for underfunding election staff, machines, etc is laughable at best, but really a tragedy of democracy. The idea that the second largest county in Florida, underfunded for this purpose, should now pull out miracles,
