NEW: Fresh on the job as @NewYorkStateAG, Letitia James reminds Judge Furman that an order staying civil litigation during the shutdown doesn't apply to the #2020Census case.

It applies only to SDNY, not Main Justice, which has this case.

The National Enquirer published sexually compromising material sent from the cell phone of the owner of a powerful news organization detested by Trump.

Do I have that right?
For those asking, I am obliquely referring to the alleged text messages of a certain billionaire going through a well-publicized divorce and owns one of the two most powerful newspapers in the nation.

And focusing on the part that matters.
The National Enquirer, whose parent company admitted to participating in a “catch-and-kill” hush-money conspiracy with the Trump campaign, is the alleged “competitor” whose values he hopes will replace those of WaPo.

On top of the changes making it easier to vote, one of the many important reforms in these bills: patching the “LLC loophole.”

If enacted, LLCs will need to disclose their beneficial ownership to the State Board of Elections, and their donations will be capped.

That’s huge. 🔽
From the Times piece, the big reform of the LLC bill appears to be transparency. Previously unaccountable shell companies will have to disclose whom they benefit.

But, as @ZephyrTeachout notes in these critiques, they appear to fall short of "closing" the loophole.
During the corruption trial of Cuomo's former "right-hand man" Joseph Percoco, evidence came in showing how the governor collected dozens of LLC donations from the energy and real estate companies tied to the scheme.

High schoolers wrote a bill to shine light on the FBI's cold case files of Civil Rights-era murders of black people.

Trump signed it yesterday, with a statement undermining it.

“I read it as I don’t know why he signed it," an SPLC rep told @Cam_Langford.

Great story by my colleague in Houston.

There's a long history of this kind of presidential signing statement. The practice spiked during the George W. Bush admin, which the ABA slammed as undermining the rule of law and separation of powers. (Archives) web.archive.org/web/2012061516…
Obama dramatically reined in - but didn't end - this tradition, and signing statements seem to be proliferating under Trump once again.

I had a conversation with my sister about the #Shutdown today. I'm recalling this as best I can. I called to tell her about a news alert regarding food stamps. Thanks to the government shutdown, stores can't process any SNAP benefits until it's over.

My sister, who is blind and has a severe mental illness, will be at risk of going without food but she supports Trump and stated that he needs the wall to keep people from taking benefits away from us.

The people who have been laid off are the ones who help stores process SNAP payments. Keeping American citizens fed is a nonessential service. THINK ABOUT THAT. If this shutdown goes any longer, people like her could be in danger of losing her health and food benefits.

A federal judge says the Justice Department's continued requests to delay a case challenging the inclusion of a citizenship question in the 2020 census are "puzzling, if not sanctionable."
Judge Furman is remarkably critical of DOJ's repeated attempts (twelve so far) to delay the census case. He says its tactics are "galling," make "little sense," an exercise in "make-work," and possibly sanctionable. "Enough is enough."

Update on the Census citizenship questionnaire case: DOJ Civil Rights Division Acting AAG John Gore's deposition will take place on Friday. Other outstanding depositions, with the exception of Sec. Ross (whose deposition is on hold by SCOTUS order) will take place by Sunday.
DOJ, meanwhile, is asking for the Census case trial to be put on hold — in large part b/c of comments made in Gorsuch's partial dissent from Monday night. DOJ filed a letter — documentcloud.org/documents/5018… — making the stay request on Tuesday. Here is DOJ's summary of it today:

1/ In recent days, conservative media sources have seriously discussed the possibility that General Michael Flynn will be permitted to withdraw his guilty plea due to government misconduct. This theory is wildly improbable, to say the least.
2/ This theory appears to have started based a standing order entered by the judge in Flynn's case. A "standing order" is an order entered by the judge in all cases of a particular type. Flynn's judge has a separate order in civil and criminal cases: dcd.uscourts.gov/judge-emmet-g-…

When did the White House know of the serious domestic abuse concerns regarding Rob Porter, the now fallen White House Staff Secretary?
(2) This question is crucial to determining whether those in the White House deliberately ignored security warnings and instead politically decided to retain Porter.
(3) As I told @JudyWoodruff on @NewsHour tonight there were at least 3-4 opportunities where WH had enough info to realize there were serious problems w/Porter obtaining a clearance and they could have, and perhaps should have, taken action. pbs.org/newshour/show/….
