JUST IN: The Supreme Court grants eight new cases today — but nothing on DACA, the trans military ban, the Title VII LGBT cases, or the Indiana abortion case. #SCOTUS
Why are we paying such close attention to this? This was, likely, the last conference at which cases granted will be heard this term.
Interesting gun/immigration case granted today where the petitioner explicitly asked the court to adopt the then-dissenting view of Gorsuch — which would require prosecutors to prove more and would benefit defendants. scotusblog.com/case-files/cas…
And, in another grant, #SCOTUS will address Exemption 4 of FOIA, which exempts disclosure of "confidential" commercial or financial information. The question: What does "confidential" mean? scotusblog.com/case-files/cas…
So, #SCOTUS will issue more orders on Monday — but those rarely include grants at this point in the term (b/c they issued grants today out of the conference). The court then will note on the dockets which cases have been re-listed for the next conference, which is Jan. 18.
We have February's calendar filled & #SCOTUS announced the partisan gerrymandering cases will be heard in March. There are already 21 other granted cases not yet on the schedule for March & April arguments. So, the court could still, technically, fit a case or two in late April.
And, of course, if the court wants to hear more cases — in May! — it could schedule them. But, that would be unexpected.
I do agree that DACA, of those closely watched outstanding petitions, is the most likely grant.
