NEW: Lawyers for Michelle Carter — the woman who encouraged her boyfriend to kill himself — are asking Mass. highest court to extend the stay on her 15-month jail sentence, pending her anticipated appeal to the US Supreme Court to review her case and vacate her conviction.
Her lawyers intend to ask the US Supreme Court to consider the constitutional right to free speech in cases involving defendants (like Carter) who "with their words alone — assist, encourage, or otherwise cause other persons to commit suicide"
#MichelleCarter was convicted of involuntary manslaughter for her boyfriend's suicide in June 2017. She hasn't been in jail as her sentence was stayed until her state appeals were done. There's a 2 pm hearing today to revoke her stay so she can start serving her 15-month sentence
Breaking: The Supreme Judicial Court has denied Michelle Carter's emergency motion to stay her 15-month jail sentence.
At a 2 pm hearing today, a trial judge will decide whether Michelle Carter will start serving her 15-month jail sentence or not. If the judge decides to revoke the stay on her sentence today, she will either go to jail today or he will set a date for her to report to jail.

Michelle Carter's lawyer, Daniel Marx, tells me that the 22-year-old understood that there was a high likelihood of her going to jail today. He says they are disappointed with today's decision, but will continue to fight for her while she serves 15 months in jail.
Carter's lawyers have 90 days from Feb. 6 to ask the US Supreme Court to review Carter's case and to vacate her conviction.

Her SCOTUS appeal will be centered on two issues: free speech and due process, Marx says.
