Disappointed to see @iandunt misunderstanding EU rights of free movement of people in his Starmer report 1/9
Free movemt of workers means right of EU cits to go to different EU state and *look* for work.

EU law says no need to:
- have a job offer before they enter
- find a job within 3 months, as long as there is a genuine chance of finding a job
- have a minimum level of resources 2/
So a national law that limits entry to EU citizens who already have a job or job offer is nothing like EU free movement of workers. 3/
Starmer’s idea for restricting job adverts to locality of the job could also be very doubtful under EU law. Since 1968 this has banned any practice which *aims or has the effect* to “keep other EU states nationals away from the job offered” Reg 492/2011: 4/
Practices which impede recruitment of workers residing in other EU states are prohibited by same law. 5/
Requiring employers to limit job advertisements to local area - as Switzerland does - is likely to violate these rules - and definitely would if its *aim* is to reduce immigration from EU. 6/
And even if it could be justified on public policy grounds by exceptionally high localised unemployment (plausible) this could never justify a *national* policy, which would always discriminate *in effect* against jobseekers in other EU states. 7/
I couldn’t see where EU has accepted Switzerland’s policy on job ads implemented in June 2018. eda.admin.ch/missions/missi… 8/
But it’s clear that Swiss opposition to full implementation of FMoWorkers is putting EU & Switz proposed new Treaty at risk swissinfo.ch/eng/framework-… 9/
The overlap between “what anti-migrant Brexiters want” and “what is allowed under EU FMoP” remains negligible. People should be told that. 10/
We need our best commentators on their toes on this issue. Because our politicians may not be. 11/11
