Lindsey Graham just lied. In his opening remarks at the Barr hearing he said that Robert Mueller told Barr that he should decide on obstruction. That is not true. There is no evidence of that in the record at all.

Graham also misled the public on obstruction of justice. It’s really stupid what he said. He said attempted obstruction of a crime that never happened can’t be a crime. I can’t tell you how misinformed that sentence is. Obstruction of justice is not about obstructing crimes

Instead, the obstruction of justice statutes prohibit corruptly obstructing proceedings. And, those statutes criminalize endeavoring to obstruct as well as attempting to obstruct proceedings.
