Defense, having another night to work through the recently turned over IAD files. Some issues have risen.

Ballistics report 1 (2015) written by Ballistic tech Lamont and ballistic report 2 (2019) by ballistic tech Faber. Both techs have been taken out of case work due to internal issues. Faber for misidentification.

Both were involved in the violent encounter within the ballistic lab where a female employee was thrown 8 feet against a wall. Fight escalated over claims of incompetence.

Moved on to cell phone extraction. Defense asked FBI agent Fennern not be used as extraction expert because he hisn’t.

At issue is info extracted from #KeithDavisJr’s phone. From defense: “Clearly, objectively, tampered evidence”

“Detective Veney very likely has a fifth amendment privilege against self incrimination”

Turns out there were multiple deletions from #KeithDavisJr ‘s phone after it was in Baltimore Police custody.

Added to issues, the bare minimum of protocol was not met by not putting phone in Faraday box (blocks incoming calls and texts)

Judge Cox remedy - Veney (even though officially listed as a case agent by state) will not be allowed in courtroom during Fennern testimony.

Other points ironed out:

Filippou IAD files will be allowed.
