This is disingenuous. The critical point is that Vote Leave rubbished the idea that there would ever be anything other than a close free trade and tariff-free relationship between the EU and U.K.

Juncker has not, I think, joined UKIP. But “no deal” means that we do join Belarus.

This is an important point, which the debate on what Johnson would have to do after a vote of no confidence under the Fixed Term Parliament Act hasn’t picked up.
The key point to hold onto is that the effect of s.2(3) and (4) FTPA (legislation.gov.uk/ukpga/2011/14/…) is that the only confidence motion *that starts the ball rolling for a general election* is one worded in accordance with s.2(4): “That this House has no confidence in HM Government”.
But, critically, there is no prohibition on no confidence motions worded differently: they just don’t trigger a general election.

In the context of the debate about what happens if Johnson loses a vote of no confidence, a reminder that we are already in a constitutional crisis.
Our government has made it clear that it will persist in a policy (no deal Brexit) with fundamental implications for all of us even if a clear majority of the House demands that it use the powers available to it to pursue a different policy.
And it also proposes to use its various powers to control the business of the House and to block legislation with financial implications so as to deny the House the chance to legislate so as to give effect to the will of the House.

Thread. In my view Steve Peers and Jo Maugham are both right: if it becomes clear within 14 days of a vote of no confidence that an alternative government led by X commanding the confidence of the House of Commons can be formed, the Queen must appoint X, whatever Johnson does.
As Jo says, there is a difficulty in working out quite how that majority signals itself. A motion of the House would make the matter clear but may be difficult to organise. A public document signed by a majority of MPs would also work, though.
If in those circumstances Johnson refused to resign and to advise the Queen to send for X he would be committing the cardinal sin of U.K. politics: he would be forcing the Queen to take a controversial political decision. The Palace would doubtless make that clear to him.

In my view EU had 3 strategic interests to protect in Brexit negs which it has done. 1. Following the portrayal of EU as weak & disintegrating during ref, EU had to assert its centrality in Europe. @BrigidLaffan
2. Membership has to matter/a departing state that wants to retain a lot of the status quo cannot be allowed to do so. 3. The rules based system had to be protected. @BrigidLaffan

1) Irish PM in Brussels for crucial talks today. The Irish backstop is THE main stumbling block to completing the UK’s withdrawal agreement from the EU. Will Varadkar push for more EU openness to U.K. proposals?
2) Varadkar is seeing (separately) the Pres of the European Council (who represents all EU leaders in Brussels) and Commission man Barnier who leads Brexit negotiations for the EU. Are there differences in opinion appearing in EU over a possible backstop solution?
3) EU insists there must be a legally binding backstop agreement - a fallback scenario that may never be used but wld guarantee that -whatever the future relationship between the EU and U.K. after Brexit - there would never be a new harder border between NIreland and Ireland
