Tip: “secret plans” to avoid the law known only to “key advisers” don’t work.
1. There will be a flaw. There always is. And unless they have got proper legal advice (which would mean the plan was known to more than “key advisers”) they won’t have spotted it.
Nikki da Costa is good. But she is not a lawyer. And she seems to have thought that prorogation under cover of a Queen’s Speech was unproblematic in law. (Which - whoever wins next week - it wasn’t.)
2. If the plan was robust, why not reveal it now? It would, after all, mean that the EU27 still faced the real threat of a crash out on Halloween (a threat we are told is important to the U.K. negotiating position).
If they are relying on surprise and not enough time to stop them, just watch the courts move. The cunning plan could be stopped in hours.
