EU27 ambassadors were briefed on Brexit today. The main points:

1. despite ongoing talks, the diplomats were told that the situation has not changed and the UK has not made proposals that the EU can accept
2. There will be NO negotiations on a legal text at the next EUCO.

3. Tusk has made it clear to Johnson that there will not be an all night session at EUCO to negotiate a legal text.
4. If there is to be an agreement it needs to be ready before EUCO

5. It’s too early to discuss contents of EUCO. Diplomats told need to wait and see if anything “serious” is tabled by the UK after Tory party conference

EU told N. Macedonia that if it solved a decades old name dispute with Greece, it could begin the process to join the bloc. That dispute has been solved at great political cost to all involved. Now, to the frustration of most EU states, France is blocking that promised progress
Macron right to say EU enlargement system needs reform. But it’s unclear why you can’t do both: reform the system and begin a process with N. Macedonia.

Not the best comparison but schools don’t close during an education reform. Italy would have no students or schools otherwise
Reality is that not keeping your word to North Macedonia, ultimately only helps those countries that wish to destabilise the western balkans and provides easy ammo to their misinformation campaigns

NEW: EU27 ambassadors have been updated on this weekend's Brexit talks.

Main points:

- no breakthrough yet

- talks focussed on customs arrangements: UK wants to distinguish between goods that remain in Northern Ireland and ones that go onto EU [customs partnership basically]
- finding an agreement on "consent" remains very complicated because the UK wants a mechanism that would allow to terminate the agreement
Putting aside merits of these ideas, the big issue is time (it's my understanding that there is no new UK text yet), and what can be done by 19/10 and 31/10, and what could be done during say a three month extension.

Question is also very much a political one for all involved.

NEW: details of today's Brexit briefing to EU27 ambassadors — according to a diplomatic note of the meeting, diplomats were told:

- UK proposals to date have not been the basis for a negotiation
- It has been made clear to the UK that any solution cannot be time limited and must be legally operative. Virtual solutions are unacceptable

- Barclay understood the EU position, diplomats were told
- In his meeting with Barclay, Barnier pushed back against the suggestion that the UK had made concessions so the EU should too

- He told Barclay that attempts at blaming the EU were not helpful

1. Backstop proposals: EU still waiting for proposals but confirm that talks have been taking place (though focuses more on what the UK doesn’t want, rather than what it actually does want)

At 10:30 today, the Supreme Court will sit *for 3 days*, with 11 Justices, on the matter of the prorogation appeals. Last time they did that was with Gina Miller's previous #Brexit case. The judiciary are wielding the big guns on this one. THREAD. 1/
Day 1: Couple of hours each for the plaintiffs in the Miller & Maugham/Cherry cases to put their arguments.
Day 2: Couple of hours each for the defendants (HMG & Advocate General, Scotland) to counter.
Day 3: "Oral interventions", 30 mins each. No Shami.

Ambassadors of the 27 EU countries meet in Brussels this morning to debate the #Brexit What's Next. Will discuss ongoing no deal preparations. Concerns in rest of EU that Dublin hasn't made sufficient preparations /2
While Dublin wants to insist there will be no hard border even in case f no deal #Brexit - others in EU - incl big player Germany - worrying about protecting single market if 500km border stays open. Berlin insists checks will be necessary though can be away from border /3

👇 I briefed EU27 Ambassadors and EP today on the ongoing talks with #UK. Following the EU-UK statement of 20 Feb, the EU has proposed to the UK a legally binding interpretation of the #Brexit Withdrawal Agreement. Most importantly:
2/5 The arbitration panel can already, under Article 178 WA, give UK the right to a proportionate suspension of its obligations under the backstop, as a last resort, if EU breaches its best endeavours/good faith obligations to negotiate alternative solutions.
3/5 EU ready to give legal force to all commitments from January letter of @eucopresident and @JunckerEU through joint interpretative statement. europa.eu/!Kj44wR This will render best endeavour/good faith obligations even more actionable by an arbitration panel.
