Time to read the SCOTUS hearing transcript from this morning because I hate myself.
FUCK Neil Gorsuch. (I guess we're turning this into a thread)
Gorsuch's insistence on forcing the lawyer who is arguing the case of a gay man who was fired to instead talk about transgender bathroom rights (a position he did not prepare for) is going to be what conservatives use to prove that we have no coherent argument.
Even Justice Sotomayor is forcing Karlan (the lawyer arguing against sexual orientation discrimination) to instead argue for trans people WHICH SHE DID NOT PREPARE FOR. The court is setting it up so it appears trans people have no defense.

Where the fuck is Alito pulling this bullshit from? The man was already hired. How is it a potential argument that the employer didn't want to hire men?

The lawyer representing Altitude Express is just a bigot and his only real argument is that he thinks gay people are icky so we shouldn't have rights.

Justice Alito with the last question doing his best to justify why he will vote that LGBTQ+ people have no Title VII protections.

Really strong argument from the counsel on why discrimination based on sexual orientation is discrimination based on sex as per Title VII
And that finishes the cases on sexual orientation. Taking another sanity break before I get to the really difficult one.
Took a walk, had a meeting, now back to the #SCOTUS arguments. Stating Harris Funeral Homes v. Equal Employment Opportunity Commission.
I feel like this is a very good argument to win this case, but it still feels very demeaning as it treats trans people as deviation on expression, but still assumes we are our gender assigned at birth.
Justice Roberts had time to read and understand the brief, yet refuses to use language that respects trans people. A trans man does not transition into a woman. She is not a trans man, she is a trans woman.
The lawyer attempts to stop the "biological sex" dog whistle, but I have zero faith that any of the Justices will hear and respect that.
This case is about if it's legal to fire someone for being trans, but all Roberts and Gorsuch want to talk about is bathrooms. They have no interest in hearing they case and only want to tell trans people we don't have rights.

Has anyone actually ever been harmed by merely sharing the bathroom with someone else? Sotomayor continues spew TERF talking points.
Justice Roberts doesn't even remember what case were on. Gender Identity is not the same thing as Sexual Orientation
I'm getting worried that even if we win this case it will be because the court decides we are our sex at birth and not how we identify.
Alito again refuses to ask questions about the proposed argument and requires the lawyer defending Title VII protections to instead defend Title IX protections.

I'm very glad for this part of the statement, acknowleding that the rhetoric used up to this point is very narrow and shouldn't be the final statement, but is used to be clear about this specific case.
Gorsuch seems to not remember that the court has made decisions that resulted in drastic changes before (Brown v. Board of Education is the obvious example)
Gorsuch's argument basically boils down to letting trans people exist might cause some confusion so instead I think they shouldn't have any rights. Can't ask for change.
Another strong response from Cole to Gorsuch, but I fear it's falling upon deaf ears.

Alright, back to the hearing, and to what will probably be the hardest part, the argument against trans people having rights.
Justice Breyer makes what I think is a sleight against 45
This is an extremely dangerous argument, and leads to the reality where Christian doctors can refuse to offer care to trans patients (See this exas case …careactlitigation.files.wordpress.com/2019/04/us-sum…)
Not really related, but "Parade of Horribles" is my favorite new term.
It's honestly impossible to understand what bigots are talking about when it comes to trans issues. I have no idea if Bursch is referring to a trans woman or a trans man in this argument. Bigot's refusal to call us by what we are just causes confusion.
I've now counted four times the "Liberal" Justice Sotomayor has called trans people transgendered. The Justices knew this case was happening. Why couldn't they take the 5 minutes to look up how to treat us with the smallest modicum of respect.
Side Note: I've had to research what BFOQ's are to understand these cases, and if we have ones that force retirement at certain ages for Bus Drivers and pilots for safety reasons, why don't implement one on running the country?
The hyperbole of these cases has been ridiculous.

I was wondering how long it would take him to claim that giving trans people rights would allow men to pretend to be trans and enter women's showers because of that (This has never happened)
46 pages in and for the first time someone has used "cisgender" instead of "non-transgender"
The crux of the argument seems to be who we compare a trans person to. If you only compare a trans man to a trans woman and you fire both that's fine. Justice Kagan is rebutting the argument well, but the lack of any other Justice to stand with her is very disconcerting.
Side Note: I'm listening to Sufjan Stevens while I read these as a comfort, but I starting crying upon hearing the line "Fuck me I'm falling apart" in 'No Shade in the Shadow of The Cross'
This is a bullshit argument. Times change, and when they do laws need to adapt.
Here's the thing, the "fight" General Francisco is referring to is that on one side, trans people want to exist. On the other, religious people want us to not exist. One of those is clearly evil. We don't have to compromise between evil and not evil.
Justice Breyer finally acknowledging that with time comes the need for change.
The greater context of this snippet is awful. Essentially General Francisco is arguing that when the Civil Rights act was passed it gave rights to people who were essentially slaves, and since trans people aren't slaves, we haven't suffered enough to have rights. #SCOTUS
This comment from Sotomayor looks promising until you realize it's in the hearing for trans rights. This is just going to be another case of using trans people as a bargaining chip. They'll let the right continue to deny us rights and kill us for some benefit to the LGBs
Final statement is back to Cole as a defense.
Tellingly, Justice Frat Boy didn't speak once during the second hearing. Maybe he was too drunk, or maybe he had already decided that trans people aren't human and don't deserve rights.
