A short Brexit update:

Understand that given the short time available, any agreement, if one is to be reached, would need to start from existing texts (eg similar to NI-only backstop as @tconnellyRTE reports here rte.ie/news/brexit/20…)
@tconnellyRTE That in mind, regardless of its merits, it's unclear how the "customs partnership" rids you of the need for a legally operative insurance mechanism.

However, a senior EU27 govt official tells me that politics will be as important as technical considerations over next few days
@tconnellyRTE Finally, if — and it's a very cautious if — an agreement is reached, it is highly likely that an A50 extension will be needed (even if just to ratify).

"There will be no Brexit on 31/10," a senior EU official told me today.

EU27 ambassadors meet tomorrow morning at 10am to discuss extension. The latest draft proposes an extension to 31 January 2020, with the possibility of exiting earlier should the agreement be ratified early
The draft also states that:

- UK has "the obligation to suggest a candidate for appointment as a member of the Commission"
- The extension cannot be used to reopen the withdrawal agreement nor to start negotiations on the future relationship, and any unilateral commitment or statement by the UK should be compatible with the withdrawal agreement

NEW: according to a diplomatic note of today's meeting of EU27 ambassadors, the main difference between France and others is not on the length of an extension to grant the UK. There is no counter French proposal. The difference is on timing (when to make the decision) and purpose
France didn't want a decision to extend to be made today, and wants to first know what the extension is for and what the UK decides to do (ratify deal, election etc.)
Most officials are confident that a decision can be made Monday/Tuesday via written procedure, avoiding an emergency EUCO (indeed, EU27 ambassadors agreed that should be the aim)

These are in my view the substantive differences between Johnson's and May's Brexit agreements:

1) this agreement creates a customs and regulatory border between Northern Ireland and the rest of the UK. It crosses a May red line, although it provides an exit mechanism in NI
2) the future relationship with the EU would be more distant, though clearer (an FTA)
3) the relationship that is envisioned in the political declaration is not a "Singapore on Thames" — an FTA would be conditional on stringent level playing field provisions as is clear in the political declaration

1. Consistency: “May’s” deal is outcome of *months* of negotiations - where both sides gave in. If UK wants to improve it, then UK must be one to table proposals - and these must respect SM & solve border. Y’day, @MichelBarnier said EU had not seen any.
2. Backstop: EU always said backstop wd only apply “unless and until” alternatives were found- but these alternatives don’t exit yet! So their view is backstop needs to stay.

To start with, let's be clear what No 10 is/isn't talking about.

They are ruling out an "NI-only" backstop which leaves Northern Irealand in EU's customs area and single market for the areas necessary to deliver a fully open border. /2
This is the NI-only backstop @MichelBarnier has in his bottom draw.

It was proposed in early 2018 and rejected by UK because it turned NI into a regulatory exclave of the EU.

No.10 and DUP say it remains unacceptable. BUT..../3

#Update: British Prime Minister Theresa May also says that the extension to #Brexit, should be as short as possible, before the European elections takes place. So this means Brexit can be postponed for at least 1 month and 3 weeks more, if the European commission will allow it!
