Keir Starmer on @AndrewMarr9 just now talking about amendments he wants to new #Brexit deal including UK membership of EU customs union NB Amending deal in UK law is one thing but in EU there is complete fatigue and no appetite to sit down and reopen deal once again /1
Of course EU would prefer all of UK to stay in customs union - in fact to stay as close as possible but there’s possibility for that to be negotiated after #Brexit when the two sides sit down to hammer out a trade deal /2
Bare bones FTA that Boris Johnson asked EU for as outlined in Political Declaration on future EU-UK relationship that makes up part of new #Brexit deal is not legally binding. All options on table after Brexit - from bare bones FTA to customs union and single market membership /3

The European Commission has started infringement proceedings against the UK for not nominating a new EU Commissioner - as instructed to do by EU leaders - even if the UK only remains in the bloc till end of Jan /1
The Johnson government had said it was unable under UK law to nominate a new Commissioner because the UK was in the lead-up to general elex but European Commission pointed out that -as EU member, EU law trumps domestic law. The Commission is the ‘guardian of EU laws’ /2
The Commission says UK must nominate a UK Commissioner so that the new Commission under Ursula von der Leyen, (rather than Jean Claude Juncker whose Commission is outgoing after 5 years)- can start work. Ms von der Leyen should have taken office on 1 Nov BUT /4

I asked @JunckerEU if he’d rather have Parliament ratify new Brexit deal or approve holding another referendum. He gave the stock EU response that the choice was a domestic one for the UK. But he said he didn’t think there would be a second referendum /1
Mr Juncker appeared to contradict Boris Johnson’s claim that he’d managed what his predecessor failed to do: get EU to blink and “bin the backstop”. Instead, Juncker said they’d found a new way in #Brexit renegotiations to come up with the same result as the original backstop /2
In practical terms, if not legally-speaking, in Boris Johnson’s Brexit deal Northern Ireland will remain part of EU’s customs union after Brexit. This is the border in Irish Sea between Northern Ireland and rest of the UK that the PM initially said he would never, ever allow /3

Jean Claude Juncker told me today he thinks #Brexit will happen by 31 January - the process has already gone on so long “it has to be brought to an end” he says /1
On Boris Johnson’s pledge to negotiate a brand new comprehensive EU-UK trade deal by December next year Mr Juncker told me some MPs and gov ministers seemed to think making trade deals was easy but they take time. The free trade agreement EU negotiated with Canada took 7 years /2
Mr Juncker said it would not be easy to disentangle UK from decades of common laws and regulations with the EU and to forge a new bilateral relationship /3

Contrary to media reports, we can't leave on 31 Oct with a deal. The EP won't have given "consent". But then, I suppose we can't expect the media to know how the EU system works. After all, we've only been in it for just over 45 years... eureferendum.com/blogview.aspx?… #Brexit

On European Parliament which also must ratify the new #Brexit deal, Mr Juncker said: "It's now not possible, not imaginable that this parliament would ratify the agreement before Westminster ... First London, then Brussels and Strasbourg".

^ They catch up eventually, although they don't understand they words they are hearing. Juncker is confirming that there can be no exit with a deal on 31 October.

What might be a very important deletion of wording from what was in the preamble of the April 2019 version of the #Brexit #WithdrawalAgreement in relation to North-South cooperation, avoiding a hard border, physical infrastructure, checks and controls. 👇

We have reached the end of the road with this Tory disaster, this quantum of #Brexit created & destroyed by & for Tories, a Frankenstein Brexit which now should tear to pieces the party that made it. Schrödinger's Brexitstein Monster, the movie. But what should @UKLabour do now?
First, it is really important for all of us in every party to know what Brexiters & #TheresaMay hoped we never would know: we were able to trigger this #Brexit attempt to become independent because by the terms of the TEU we were in fact independent & free to use #Article50.
As @joannaccherry has insisted in Parliament (something also said almost in passing by Kenneth Clarke), we can #RevokeArticle50 now to avert a disastrous #NoDealBrexit. That doesn't have to be the end of Brexiter hopes. It gives us the time that we need to reflect & rethink.

1) 6 pointless, time wasting exercises the Tory & Labour parties want to put the country through before we can start work on #Brexit

There are only 2 options left, May’s deal or Remain. There’s no majority for no deal and no time or appetite for a new negotiation

2) There is only 3 months left and the country is in a state of worry. Despite this, and despite the ticking clock the 2 major parties are insisting on self indulgent frippery and posturing before we can get to the real business of fixing #Brexit
3) Lets take the Tory party. Firstly, they’re about to engage in another Leadership contest. May will probably win this but even if she doesn’t it will consume weeks of time for no purpose because it won’t itself change anything in Brexit. The same issues will exist afterwards

1/ Theresa May has made 3 fundamentally incompatible #brexit promises regarding Northern Ireland at least one of which she has to break and one of the 3 groups she will have to betray
2/ Theresa May has promised A. Continued open border in Ireland to the Irish B/ to the #Brexit hardliners that we will withdraw from the customs Union and single market and an end to open borders C/ no difference in #brexit terms between Northern Ireland and rest of the UK
3/ the only way to keep the promise of No hard border in Ireland is to stay in single market and customs Union. This will incense the tory #Brexit hardliners as it will result in losing any say on making rules we still have to obey rendering brexit pointless
