That is because, under Article 5 of the NI protocol agreed by the Johnson Government, the default rule is that *all* GB to NI exports are subject to *all* EU customs rules and tariffs, unless it is *proved* that they will stay in NI *and* that they will not be processed in NI.
The UK government can refund those duties to NI companies. But only if that complies with EU state aid rules. Which continue to apply in full in relation to NI (Article 10 of the protocol).

No coherent response by @DouglasCarswell to my question on exactly what bits of the current judicial review test he objected to. Instead, an immediate ad hominem attack (along the lines that lawyers like JR) and a vague complaint that judges just substitute their own decisions.
Those that argue that judicial review needs to be cut back need to do better than that.
And @cath_haddon made an excellent follow up on the lack of any evidence base whatsoever for @DouglasCarswell’s claim that JR frustrates attempts to improve public administration.

Well, this is going to lead to loads more work. For example, every single aspect of interpretation of VAT rules is now up for grabs, at Tribunal level up. Bad news for HMRC, though. And taxpayers, overall.
See also vast swathes of regulation ranging from waste to financial services to employment law and on and on ...
I suspect the Government will regret this.
