1/ This vote by the Commons last night is being interpreted by some to mean that EU citizens will definitely have *no* appeal rights in relation to immigration status after Brexit. This is not correct.
2/ The withdrawal agreement bill still gives the government the power to adopt secondary legislation setting out appeal rights. So it's not true to say "the Commons voted to say that no one will be able to appeal".
3/ Here's the minister's rationale for opposing the amendment: needs more detail than the amendment would provide, claims it might have undesirable consequences. But not objecting to very existence of *any* appeal rights. Indeed minister says EU citizens *will* be able to appeal.
4/ The memorandum on delegated powers also explained more detail about appeal rights under the bill.
5/ The broader context is that the withdrawal agreement requires there to be appeal rights in relation to residence decisions and the settled status decisions per se. This applies equally to UK citizens in the EU, if a Member State (like the UK) requires an application process.
6/ As regards residence rights, the withdrawal agreement refers to EU free movement law. Here's what that law says about appeals.
7/ It's understandable that people distrust the government due to Vote Leave folks reneging on their promises, and unpleasant rhetoric about EU citizens. Its actions need to be scrutinised closely. But it's premature to claim that "EU citizens will be not be able to appeal".
