European Council Guidelines: A thread. Firstly, yes we (the EU 27) want to have a a deep a relationship with the UK as possible including on security...... (1)
But....the UK red lines mean there will be friction. Which we think will be damaging to the UK... (2)
However....if those red lines become a bit more 'pink' we can look at giving your more. But don't think we're going to offer anything we've already ruled out..... (3)
The EU27 come back to one of their favourite phrases- no "cherry picking". And reiterate the UK cannot participate or have a say in how the EU makes laws/regulations. You'll be outside the tent. And if you want to follow EU rules that means being subject to the CJEU.
What does this new trading relationship with the UK look like to the EU? Firstly it will be based on a 'wide ranging Freed Trade Agreement (FTA). So the EU are starting from the more minimalist FTA model and building up, CETA with bells on. (5)
On goods: EU will SEEK to maintain zero tariffs- so there's no guarantee. On fishing they want "existing reciprocal access to fishing waters", the key word is existing, so they are starting from a status quo position (This is a negotiation of course!) (6)
On services: References to host state rules means, I believe, UK companies will have to set up subsidiaries in EU countries. NO mention of financial services. Reference to the enforcement regime, a signal on services you're looking at Equivalence (7)
On movement of people, they want an "ambitious" model. Underlines no discrimination amongst member states, EU 27 to be treated as one- and reciprocity, you'll only get what you give. Also references social security & professional qualifications. (8)
This all sounds like EU immigration regime is going to have to include more privileged access than non-EU citizens. Not many concrete proposals, so a lot of horse-trading to be done here (9)
On other areas, they want an air-transport agreement and other co-ordination on transport. But outside of this, education, culture, research, all references are to UK being treated as a third country. No mention of Chemicals and Medicine agencies UK wants to remain part of (10)
This section expresses EU fears of UK gaining competitive advantages from Brexit. So they want a strict enforcement regime and UK to keep similar regulatory environment & standards. See here justification for "Canada access/Norway supervision" style scenario... (11)
They say, the UK is so close and intertwined to the EU, of course we have to ensure any access comes with a very strong enforcement mechanism. But UK will say if you want heavier enforcement, this means much better access than other third countries. No cake & eating it (12)
On other areas outside trade, EU confirms they want a deep relationship, for example on judicial/criminal matters, but point to limits with the UK being outside Schengen (13)
Strong cooperation on foreign and defence matters, but EU underlining they will make independent foreign policy, another reference to the UK being a third country, i.e. you won't have a place at the table when we discuss these matters internally (14)
A reference to dispute settlement and underlining again the EU position that the closer the relationship the more the UK will have to be subject to supervision of EU bodies. 'Autonomy of EU legal order' reference is saying we won't be subject to higher authority either (15)
Last point, a little niche, but interesting mention of Federica Mogherini's role. There have been debates as to whether the High Representative & her staff should be leading on negotiations on future defence & security relationship, or if that will remain with Barnier's team (16)
