1/ I see some confusion about various different court cases related to Brexit. I'll summarise here what the different cases are about, with links.
2/ First, the Shindler case. This challenges the EU decision to start withdrawal agreement negotiations, on the grounds of several alleged legal flaws including the voting franchise. EU General Court rules tomorrow. Detailed explanation here:
3/ Second, the Wightman case. This is about whether the Art 50 notification can be unilaterally withdrawn. Scottish court asked CJEU to rule; Full Court hearing on Tuesday.
Background to litigation: eulawanalysis.blogspot.com/2018/11/scotch…
Discussion of legal arguments: eulawanalysis.blogspot.com/2018/01/can-ar…
4/ Third, the Wilson case. High Court hearing in UK set for Dec. 7th. This argues that the notification was invalid because of the breaches of electoral law which the Electoral Commission has established. Details here:
5/ These are the main cases. There are also:
- legal challenges to the Electoral Commission decisions and to the @ICOnews fine on Facebook/Cambridge Analytica
- pending investigations into electoral spending issues, and
- Mr Mueller may be interested in some friends of Mr Farage.
6/ I don't speculate on the outcome of cases, but remember there's never a guarantee of getting the outcome you might wish for, and that even if one of these results goes 'against' Brexit it won't necessarily stop it. The consequences and next steps would depend on the details. /
