1. Trump appears edging toward declaring a "national emergency" and attempting to unilaterally build the wall.

This could backfire spectacularly.

Let's review.

2. Under the National Emergencies Act of 1976, if Trump declares a national emergency to build the wall, the House could immediately pass a resolution to rescind it.

The Senate would then need to vote on the House's resolution within 18 days.

3. So it would require 50 Republican Senators to vote to undermine and subvert their own legislative authority.

This seems unlikely.

On the other hand, Republicans in the Senate have been generally unwilling to stand up to Trump

4. At the same time, Congress revoking Trump's phony "national emergency" could be a good outcome for Trump.

He gets out of the corner he's painted himself into and gets to blame Congress for his failure to build the wall

5. Congress would only be the beginning of Trump's problems. He would also likely face lawsuits from landowners along the border. He'd need to seize their land and, of course, there is no real national emergency.

1. It's likely that the current shutdown is illegal.

There is a fundamental misunderstanding of the law in these situations.

2. The standard line is that the Antideficiency Act (ADA) allows the government to force essential employees to work without pay.

THIS IS NOT TRUE.

In general the ADA prohibits the government from spending money not appropriated by Congress.

3. The ADA also prohibits the government, in most cases, from accepting volunteer services from government workers.

The exception to this rule is "emergencies involving the safety of human life or the protection of property."

President Trump just said about declaring on national emergency: “I think we might work a deal, and if we don’t we might go that route.”

He also says he has the “absolute right” to declare an emergency. The “threshold” for declaring one is if he can’t make a deal, he says.

6. Keep reading...you'll see there are statements and instructions in this order about the immediate construction of the wall, using ALL available resources, securing long term funding, etc. That's why this message from POTUS was no surprise!

7. Q told us there was a w for POTUS to circumvent congress. qmap.pub/read/2502 talks about how POTUS can use constitutional right to secure border for national security. Now, right DJT is talking about declaring state of emergency to enable military to build the wall.
8. But wait, he already did that! The executive order I told you about stems from one MAJOR declaration made LONG before 4-10-20 took office. We are currently in a state of war against? Terrorism. We have been in the war on terror since Sept 20, 2001.
