"Based on her performance at the Justice Committee, she obviously holds a very high opinion of her decision-making capabilities, and doesn't have a lot of time for the opinions of others."

I don't trust her anymore either.

Excellent read:

"JWR contention that due diligence was exercised was not documented"

20 communications/107 days (emails, calls, meetings)

107/20 = 1 every 5.35 days

Most communications were internal between staff. She only took a few meetings.

JWR admitted to "high anxiety" over this? Seriously?

Does she understand real anxiety & what real people go through?
Good thread by P Doroshenko, QC:

"I’d explain the law and I felt she didn’t get it. The changes she made to impaired driving law make me think she didn’t really get the Charter. She seemed completely unforgiving of (other people’s) human failings."

On the @carolemacneil news show tonight @PeterMacKay falsely said that economic considerations cannot be considered for a DPA with SNC.

If that were the case, no Company would ever get a DPA.

Good thread by Adam Goldberg, Lawyer:

5/
Here's the conditions for DPAs or Remediation Agreements. Note under "Factors to consider (2)(i):

"Any other factor that the prosecutor considers relevant."

Such as economic considerations of 9,000 innocent Canadians, 1000s of pensioners, & hundreds of sub-contractors.

6/
Here are the reasons the Canadian Bar Association was in favor of DPAs in their submission to the government in 2017.

They are a win-win for taxpayers and for innocent Canadians.

7/
"A DPA is not a way to get a crooked company off the hook: It is a way to make sure it is rehabilitated, watched, and financially punished for what it did. All of that must be judicially approved and monitored."

Mr @PeterMacKay was also wrong on the @carolemacneil news show when he said nobody should have approached JWR after Sept 4th when the DPP had decided no DPA would be given to SNC!

"My mind is made up” would constitute prosecutorial tunnel vision...."

Pressure or Lawful Advocacy?
"Two people can look at something and see it completely differently but it’s possible for both to be correct. Unfortunately we are living in a world where each sees it differently and then claims the other is completely wrong."
02/28/19. Power & Politics, CBC:

Irwin Cotler, former Attorney General of Canada,

“I think what you saw there was Number 1 an internal tension in the dual roles of the Minister of Justice and the Attorney General. As Minister of Justice she’s a member of the Crown.

11/
"She’s part of cabinet secrecy, cabinet confidences, cabinet solidarity but as the Attorney General she has to give independent legal advice to the crown as she put it: ‘I have to speak my truth’!

12/
"The 2nd thing was the interactive dynamics between the Ministers, the other Ministers, their staffs etc., and the Attorney General. Their speaking out of their political hat and they see her in terms of another Minister of the Crown and her political hat.

13/
"They don’t always appreciate, not only this government, but other governments, that she wears an independent legal hat and that she has this responsibility for the protection of the rule of law.

14/
"I believe that those who were making representations to her were genuinely believing that they were not engaged in any illegal activity or even pressuring her illegally.

15/
"I believe they were trying to share with her what they felt was information she needed to know to make the best decision.

I think she believed and understandably that she was subjected to as she put it “constant and sustained pressure” because while each of them was

16/
"making their own representations separately as of 10 or 11 people she felt all 11 representations. It was cumulative. It had its impact and in her view she deemed it inappropriate.”

Pressure or Lawful Advocacy? Can two people be right at the same time?

Sheila Copps asks why Jody Wilson-Raybould and Jane Philpott want to stay in Liberal caucus

"Both were apparently so deeply scarred that they have turned on their own.

To these renegades, resignation is an act of high principle. To those less-enlightened, it is an act of personal pique, misplaced morality and destructive short-sightedness."

Is the SNC-Lavalin affair a failure of governance or a failure of journalism?

"Schadenfreude. The German concept of taking delight in the misfortune of others. It’s a particularly journalistic attitude."
