Suing Twitter and Liz Mair for $200 million is exactly what I'd expect a ding dong like Devin Nunes to do. In the lawsuit he claims that Twitter's failure to police mean memes, among other things, caused him "extreme pain and suffering." GTFOOH, ding dong.
Oh, excuse me he's asking for $250 million, according to the complaint.
Here's the complaint. A lot of these don't sound like false statements of fact to me. Loootta opinion stuffed in here from, I don't even know how to describe them: meme accounts? mean accounts?

This is a tweet from one of the meme accounts that Nunes objects to. The account has been suspended.

According to the complaint, Twitter's failure to police this image, among other things, caused Nunes "extreme pain and suffering."
This, however, is not a well-written pleading. Quote: "As part of its agenda to squelch Nunes' voice. . . *Twitter did absolutely nothing.*"

(Presumably, they mean Twitter did nothing despite a duty to do something.)
Para 35: "The ability to use Twitter is a vital part of modern citizenship." "Twitter is essential for an individual to . . . engage in any level of political organizing in modern America."

Para 59: the court should order Twitter to permanently suspend Liz Mair's account.
Bah. The ask is $250 million compensatory and $350k punitive. Thanks for the corexx, guys.

I had vaguely recalled this Nunes winery investment business, but had forgotten all the details. The Fresno Bee reported on it in a piece headlined: "A yacht, cocaine, prostitutes: Winery partly owned by Nunes sued after fundraiser event." fresnobee.com/news/business/…
The only defamations specifically alleged to be from Mair in the suit (it claims there are others, but doesn't specify them; see prior not well-pleaded comment) involve mentions of the winery investment and Fresno Bee story.
In fact, the complaint specifically objects to a Mair tweet that is simply "HOLY CRAP" followed by the headline from the Fresno Bee and a link to the article. That ain't gonna work.
Almost all of these aren't false statements of fact. It's counterproductive, I would think, to provide the public with a hyperconcentrated list of insults that by your own admission really, really bother you.

*Note: Nunes is also suing for insulting words/fighting words.
Nunes filed in Henrico County, Virginia (which is where Twitter has a service address), but, of course, the defendants could try and remove it to federal court if they wish.

Virginia has an anti-SLAPP law. It is not a very good one tho.
I can't imagine Rep. Nunes has managed to serve the anonymous mean meme accounts yet.
Anywhooo, I appreciate the kind words, guys, but I express no opinion on the ultimate outcome here. Defamation/insult and, er, negligent defamation (???) isn't my area of law.

Rep. Nunes says today's lawsuit is "the first of many."

Nunes says "we're actually going after Twitter first" because "they are the main proliferator, and they spread this fake news and this slanderous news."
