1/ Doing research into our upcoming deep dive series into the Mueller Report and I have a question: we know that Mueller didn't charge obstruction in Volume II because of the DoJ policy that disallows indicting a sitting president, but...
2/ Are we sure we are correct in our speculation that coordination and conspiracy weren't charged because of insufficient evidence? In the justice manual as described on page 9 of volume I, Special Counsel points out that to bring charges...
3/ Would prosecuting the crime serve a substantial federal interest that couldn't be satisfied elsewhere or by NON-CRIMINAL alternatives. Considering the counterintelligence piece isn't addressed in this report and could be open and ongoing...
4/ What if SCO felt that federal interests could be better served by a counterintelligence investigation into Trump/Russia coordination and conspiracy? Then all the activity outlined in Volume I with all the Russia contacts would not meet the standards...
5/ set forth in the justice manual. So we have to ask ourselves: were crimes not charged because Mueller lacked key pieces of evidence or because prosecuting these as crimes could be satisfied elsewhere in non-criminal alternatives such as a counterintel investigation?

1/ What we expect Thursday, and what we want, so there's no confusion: We don't expect anything, nor do we know what's in the report. We have been called the "librarians" of the Mueller investigation, we will report what we get.
2/ We might speculate about what we think is under the redactions, but we will be clear about what is actually there and what is theoretical. We believe the public should NOT get the full, unredacted report with underlying evidence and grand jury materials...
3/ We DO think, per precedent, that congress, at least the gang of 8 SHOULD get the full, unredacted report with all underlying evidence and grand jury materials. Anything less is unacceptable.

1/ Attorney General Bill Barr needs to recuse himself from ALL 20 investigations handed off by Mueller, including the Mueller investigation proper & should NOT be responsible for redacting the Mueller report. Check out ALL the ways he's TOTALLY conflicted:
2/ First, Barr reported on his financial disclosure that he had earned up to $15K from the Vector Group, which is headed up by Howard Lorber. Lorber is one of the 3 calls DTJR took after the June 2106 Trump Tower Meeting.
3/ Lorber is a real estate developer and OLD friend of Trump, having traveled with him to Russia to talk about building a Trump Tower Moscow. But it gets worse! Barr worked at the Kirkland & Ellis Law Firm, and that firm represented Alfa Bank. You know who else worked there?

The grand jury met Friday? Justice porn fantasy: Mueller’s grand jury was disturbed by Barr’s characterization of the Mueller report, so they’ve petitioned Beryl Howell to release their findings to the House judiciary, just the the Watergate grand jury did #superspacebeans

The only reason I can think of that Judge Howell would NOT release the materials is because the grand jury is still “continuing robustly”, and we learned from the secret company from country A, that you can’t release the stuff until the investigation is over. @BarbMcQuade ?

putting language into approps bills saying "no money shall be spent on X." He keeps saying "that was just a thought piece" & that he wasn't actually taking a position, &he said it again in response to a question from @SenBlumenthal. But this simply isn't true.

1. Don't forget the context: it's pretty incredible that we are having a conversation involving law enforcement officials about whether Trump can be indicted. That's astounding.
2. And don’t forget the source: Giuliani. He’s not exactly a stickler for details.
3. Context may really matter here. Why did Mueller say this? Is it because Trump’s lawyers said they were thinking of taking 5th Am priv against self incrimination, and Mueller said there can be no "incrimination"?
