Where the rubber hits the road is the use in this indictment of wikileaks’ statements that it “accepts” classified and its publication of a list of “most wanted leaks” to show solicitation and whether one thinks that conduct is different from what national security reporters do.
Unless the theory of criminality turns on some narrow semantics, it’s hard to see the distinction. NYT and WaPo, for example, make it abundantly clear in various ways that they will accept secret national defense info and provide signals about what secrets they’re interested in.
The indictment is all about the Manning leak, btw. There’s nothing about the 2016 election or Russia here.
