A brief history of Hawaiian Land Tenure:

1840- 1st constitution grants vested rights of three classes-Moi-na alii- kanaka in all the lands of Hawai`i

1843- Anglo-Franco Proclamation recognizes Hawaiian Kingdom as achieving recognition as an independent and sovereign state
Brief title history for Mauna Kea:

1848- the Mahele establishes Hawaiian Kingdom government and crown lands (both continue to have the vested rights of kanaka)

1848- the ahupuaa of Kaohe,
Hamakua is gifted to the Hawaiian Kingdom government as a result of the Mahele. Kaohe
Includes all of the summit of Mauna Kea and up to the top of Mauna Loa.

Jan 17 1893- US troops aid in a coupe de main of the Hawaiian Kingdom government

1893-1900- All Hawaiian Kingdom government and crown lands confiscated and seized by the Government established because of
Troops. This includes Kaohe and Maun Kea

1893-1959 over 360,000 acres of Hawaiian Kingdom government and crown lands sold or exchanged by the Government put in power because of US intervention

1959-2019 approximately 1.8 million acres of land transferred to state of Hawai`i
By the US federal government who held lands without clear title. These lands are deemed 5f trust lands and often referred to as the “ceded lands”
Although nothing was ceded because there was no treaty of annexation to cede territory.

Kaohe and Mauna Kea is a part of these lands
In after the overthrow in 1895 instead of calling them the Hawaiian Kingdom government and crown lands they re-named them the “public lands”

This was done to mask the genealogy of these lands to the Hawaiian people and to mask the theft and cloud on title.
