Breaking: the unsealed version of the Plaintiffs' Motion for Summary Judgment has been posted in the $TSLA SolarCity case in Delaware. Ernst & Young determined "THE COMPANY COULD NOT OPERATE AS A GOING CONCERN." See Document 306 (may be renumbered later). plainsite.org/dockets/32atfy…
Further detail:
This post happened today because the Plaintiffs requested that the redactions be lifted on September 13th; it's now 10 days later per Rule 5.1(f). The request was possibly made because on the 9th, PlainSite sent an e-mail to their counsel asking if materials would be made public.
Think Computer Foundation (which is part of the joint venture that runs PlainSite) filed its own request for all exhibits to be unsealed as of September 19th. That means that unless objections to the request are filed by the 29th, they'll be made public on the 29th.
