During oral argument at SCOTUS today, Louisiana’s solicitor made the dubious claim that all 32,000 people in Louisiana prisons could challenge their convictions if the Court rules that unanimous juries are a constitutional requirement. Justice Gorsuch had an interesting response.
Justice Gorsuch’s response to Louisiana’s dubious claim at oral argument in Ramos v. Louisiana: “You say we should worry about the 32,000 people imprisoned. One might wonder whether we should worry about their interests under the Sixth Amendment as well.”
Justice Gorsuch then asked: “Should we forever ensconce an incorrect view of the U.S. Constitution for perpetuity, for all states and all people, denying them a right that we believe was originally given to them because of 32,000 criminal convictions in Louisiana?”

Two important cases will be argued at the U.S. Supreme Court this morning:
(1) Ramos v. Louisiana challenges criminal convictions based on non-unanimous jury verdicts.
(2) Kahler v. Kansas challenges Kansas’s decision to abolish the insanity defense in criminal cases.
The litigation about non-unanimous juries was spearheaded by Calvin Duncan. He conceived the legal claims while helping fellow prisoners file briefs during his time in prison at Angola. Calvin was wrongfully convicted in 1985, released in 2011.
The @NAACP_LDF filed an amicus brief in the Ramos case which reminds the justices that Louisiana enacted the non-unanimous jury law at the same time black people were first allowed to serve as jurors. The intent was to make it easier for white jurors to convict black people.

#RodneyReed's attorneys just filed a motion asking a Bastrop County judge to cancel Rodney's November 20th execution date. The motion raises two new pieces of evidence that implicate Jimmy Fennell, the victim's fiancé at the time of her death, as the real killer.
Reminder: #RodneyReed was convicted and sentenced to death for the murder of Stacey Stites. The evidence comprehensively shows that Rodney is innocent and implicates Fennell as the real killer. The prosecution's case against Rodney is "medically and scientifically impossible."
First piece of new evidence: An insurance salesperson recently signed a sworn affidavit saying that Jimmy Fennell threatened to kill Stacey Stites while they were purchasing a life insurance policy.
