It looks to me like the Supreme Court is going to uphold the Trump administration's DACA rescission, probably by a 5–4 vote. I think the conservative majority will say that the rescission was handled lawfully, while a few conservative justices will say DACA itself is illegal.
No surprise: Justice Sotomayor asked the most powerful question, wondering why the administration said it had no "choice" but to rescind DACA instead of acknowledging its "political decision" to "destroy people's lives."
Justice Gorsuch captured the tone on the conservative side: "I hear a lot of sympathetic facts out there and they speak to all of us," he said. BUT he then suggested that the court is obligated to uphold DACA rescission, even though its beneficiaries will suffer.
Chief Justice Roberts appeared not to fully understand what's at stake here. He said this case is only about DACA's benefits—like work permits—rather than deferred deportation itself, adding that the Trump administration has "said they're not going to deport these people."
Given the administration's aggressive efforts to deport individuals *who still have DACA*—even fabricating evidence to secure their deportation—I do not think Roberts is correct that Trump won't have DACA beneficiaries deported if the program ends. slate.com/news-and-polit…
