The issue is that Khan’s appeal went through months after Dec 2012 axing of IPPs by the Tories but his earlier conviction date meant the Tory changes on parole also from the Dec 2012 act didn’t apply. So he basically slipped through the gaps in two legal regimes. Who’s to blame?
Tories will of course point out that the European Court of Human Rights ruled IPPs unlawful in 2012 and there was a lot or concern about them being misused and lower level offenders being locked up indefinitely.
Yvette Cooper also raising the question of whether other tools could have been used to ensure convicted terrorists were not released without the parole board looking at their cases or additional monitoring 👇🏻

Expect this to escalate in coming days...

- Tories will paint Corbyn as soft on terrorists.
- Labour will say Tory cuts to policing, probation and prison issues are making the country less safe.
- Plenty will feel despair that a tragedy like this will inevitably be politicised.
Former Reviewer of Terrorism legislation says the appeal court had a choice between an IPP and a determinate sentence (with auto release) as per the pre-Dec 2012 legal regime and chose the later. Says he’s “not attracted” by the political blame game.
