JUST IN: New York DA Cyrus Vance files its brief to the Supreme Court in its case seeking enforcement of a grand jury subpoena for President Trump's financial records as part of a state criminal probe. Oral arguments are scheduled for 3/31. Read it here: ow.ly/6x0n50ywFtD
Vance ?s the DOJ memo on presidential immunity while in office, writing: "To the contrary, immunity from investigation for private conduct runs counter to precedent, the structure and operation of the Constitution, and the bedrock principle that no person is above the law."
Vance explains that the probe into the Trump Org had been shelved for a time during the feds' investigation of hush money payments and Michael Cohen. But once it saw in July 2019 no further charges were coming that's when it got going again.
Notable that this Vance case (and a separate one being argued back-to-back next month at SCOTUS involving congressional subpoenas) is what the president is referring to when he says Justices Sotomayor and Ginsburg should recuse themselves: politico.com/news/2020/02/2…
Vance argues that immunizing a president "from criminal investigation while in office could effectively provide immunity from indictment and prosecution
after a presidential term due to the loss of evidence."

@politico The Vance brief concludes with this shot at Trump saying his lawyers have "failed" to show that their subpoena creates "a burden that would unduly interfere with his ability to perform his official duties or that it is a bad faith effort at presidential harassment."
