The recent attention in the media to the pressing issue of #DocumentedDreamers gives us an opportunity to take a bigger view of immigration issues. The issue of kids aging-out is an unintended though not unforeseeable consequence of massive #GCBacklogs.🧵 👇 1/9
Fundamentally, this is a demand-supply and allocation issue. The number of #GC annually given out has not changed meaningfully since 1990. Meanwhile the US economy and labor market today are completely different from back then. 2/9
On top of this supply issue of #GC is the fact that their allocation is not equitable. How long you wait in line, usually boils down to the country you were born in. Not on skills, education, work experience, duration of stay in the US or contribution to the economy. 3/9

Arguments linking per-country caps to maintaining diversity in America are used repeatedly. They came up yet again during the house judiciary committee hearing on 04/28, so we wanted to take some time to address it. 1/12
The thing being considered right now, is the removal of per-country caps in EB immigration. The caps apply to immigrants in this category who are ALREADY in the US and have been awaiting their turn for a green card for years! 2/12
Eliminating these per-country caps wouldn't let in any more EB immigrants into the US annually than right now. It would just make it make everyone stand in the SAME LINE for them, irrespective of their country of birth. 3/12

Do I deserve this discrimination-I was finally happy to have my #H4EAD approved, and was tracking it all the way. Today 14th dec, it showed delivered to my mail box. I rushed to get it, but nothing was there. I got scared! & blank for a moment! Called USPS worrying about my mail
I was in 1 hour waiting. I realized what will happen to it, I waited for it endlessly and now I am fearing to loose it. I rushed to the USPS. Told them that my EAD is very important document and the mail shows delivered however it’s not delivered. She went inside to enquirer and
I was totally numb by that time thinking I can’t afford another more months in tensions, stress of H4EAD delay. She came at counter and told me my “EAD” is not delivered yet and I can collect directly from the mail man who is in my area. I thanked her and rushed back to find him.

Another new week, another thread to clean up the dirt being tossed around by #S386 & #HR1044 opponents. This includes a lot of AILA atty's and a lot of "scholars" from a certain 2 nations. Again, not surprised at all because equality feels like oppression to them. Lets begin
#S386 / #HR1044 will make it impossible for "scholars" to come to the Universities here from ROW (mostly the 2 nations). FALSE-you come on F1/J1 visas to study. This bill only pertains to Employment based visas (EB1/2/3 etc). If you are so supremely skilled, get on H1B or other
work visas and then join the queue for employment based GC's like everybody else. Recent restrictions on F1/J1 visas apply to every nation. You are not the only ones affected. So quit whining and get to "work"

I am going to try & disspell the lies/misinformation being peddled by those who oppose #S386 / #HR1044 . This will be a series of tweets and hopefully, I can stay civil because good lord we have beem taken advantage of for decades.
Its a GC giveaway bill for Indians- False-
It eliminates country caps from EB GC's so now every skilled immigrant from every nation gets to play by the same rules & on the same grounds.Nowhere does it say that Indians/Chinese will be given preferential treatment. #S386 #HR1044
This bill will make it impossible for ROW applicants to get GC's - False. It will only make everybody wait for the same time before their PD becomes current. Currently, Indians and Chinese bear the weight of the backlog- how is that fair? #S386 #HR1044

How does S386 impact diversity?

Anti-S386 activists claim the bill is anti-diversity. But is it? Let's look at it with data.

According to the US Census, the total US population was 318.7M in 2014. It is projected to be 416.8M in 2060.

- Asian population was 17M in 2014 and projected to be 39M in 2060.

- Indian population in 2015 was 2.4M, which represents just 0.7% of the population.

- Assuming same rate of growth as the overall Asian population, Indians' population in 2060 will be 5.5M (1.7% of total).
For comparison, Hispanic population will grow from 55.4M (17.4% of total) in 2014 to 119M (28.6%) in 2060.

Now, let's assume S386 is passed and country cap discrimination ends. This could lead to Indians getting up to 50% of total world allocation or ~50,000/year.

We hope @SenatorDurbin will sit down with colleagues & get a deal done on #S386. No one ever passes a bill with a UC show to deflect & humiliate others. A bill can only pass if differences are negotiated. Our advocacy will intensify until talks occur ->…
Today, Durbin tried to put on a show that he wants to do something for the people suffering in the backlog. But we know his approach is not intended to reach a deal.
A person who wants to reach a deal does not create floor drama over paper-thin policy differences that can be resolved in a 1-hour meeting.

#S386 my understanding 1. @SenatorDurbin want no harm clause, but do not want transition period extended to 9 from 3 years, which is the practical way of ensuring #noharmclause, it will ensure #row with #ApprovedGreencardPetition will get #greencard without impact for 9 years
2. 50/50 rule for companies employing #h1b :- @SenatorDurbin wants it effective immediately, @SenMikeLee wants to provide 3 years to make this transition, immediately applying 50/50 rule will cause to job loss & deportation of #indiaborn #skilledimmigrants
Cause they r one who r forced to stay on #H1B for decades despite of having #ApprovedGreencardPetition for decade. 3 years will help most of them to get out of #h1b & rest will get AOS in meantime.

Trump's next move is to force long time H-1B visa holders out of the U.S. and in this thread I explain how and why, but first read @NFAPResearch Forbes article from today:…
When I saw the H and L visa ban from Monday, I immediately saw the language that they discuss in the article. The immigration law is being used by Trump's disciple Stephen Miller like a surgical tool, carving out as much legal immigration as possible. But why? read on
Conservative GOP Senators have Trump's ear, and they told him to suspend major visa categories. These include Cotton (R-AR), Cruz (R-TX), Grassley (R-IA), and Hawley (R-MO).…

Such a good panel on legal #immigration from @1a @toddzwillich @AveryJCK, w/ @Puneetkaurc (immigrant stuck in the green card backlog), @EleanorPelta (attorney) & @ahauslohner (reporter).

Includes a helpful interview with @RepZoeLofgren about #S386. 1/…
@1a @toddzwillich @AveryJCK @Puneetkaurc @EleanorPelta @ahauslohner @RepZoeLofgren @toddzwillich asks about the political economy of the #immigration system: Doesn't Big Tech get whatever it wants?

Answer from panelists: Nope!

Companies are always jonesing for more #H1B visas, but haven't gotten their way since 2000, I believe?
@1a @toddzwillich @AveryJCK @Puneetkaurc @EleanorPelta @ahauslohner @RepZoeLofgren Quick political guide:

* Temporary work visas (#H1B etc): Loved by employers; loathed by workers lashed to said employers

* Permanent residency (#GreenCard): Liked by (most) employers; loved by workers empowered to switch jobs & bargain for wages; better for US-born workers

What's looming for the legal #immigration system in 2020? Here's a forecast from the @chooseboundless team. (Spoiler alert: Nothing good...)…
@chooseboundless Let me revise that — some good (and potentially good) #immigration news is on the horizon for 2020.

For example, thousands of #immigrants from #Liberia suddenly find themselves able to apply for green cards this year (and ultimately #citizenship).…
@chooseboundless And the dream of green cards for some 800,000 (mostly) Indian immigrants is still alive — if in 2020 Congress can broker a compromise that Trump will sign into law.

The Fairness for High-Skilled Immigrants Act (#S386) began with a simple premise: one green card queue for everyone, regardless of home country.

As helpfully explained by @gsiskind, the latest version adds two very consequential extras... 1/…
@gsiskind First, a raft of new constraints on employers that #H1B skeptics have sought for a long time.

Perhaps the biggest deal is a ban on US companies (w/ <50 workers) having more than 50% of their US workforce be H1B or L visa holders. That could crush some IT consulting firms... 2/
@gsiskind ...but perhaps also the occasional post-Series B startup that happens to employ a lot of foreign-born tech talent?

Curious for reactions from @nvca @TechNYC @TechNetUpdate @EngineOrg @AngelList @ycombinator @techstars @enginexyz! 3/

reorganizing the #tamu #cognizant irony (see fig.1) posted yesterday night for better readability, American ppl deserve to know what the outsourcing companies are doing to their jobs before #s386 is sneaked in by @SenMikeLee . #s386 is SIMPLY UNAMERICAN! #nos386 #reliefact
Now all #s386 supporters who refuse public hearing, give a proper reason why #cognizant is preferring ppl from 1000 ranked oversea schools over US top engr universities like #tamu. If it happens for #tamu, it can happen to #harvard #mit #yale once #s386 passed. #NoS386!!!
For short, outsourcing companies would rather hire anyone than smart native American grads! And senate is acting as a rubber stamped for their interests? #s386 MUST BE STOPPED!!!#NoS386 @SenatorDurbin @SenHawleyPress @SenatorRounds @MarshaBlackburn @SenGillibrand @ChuckGrassley

Given all the inaccurate info here about #S386/#HR1044 and country caps as a maintainer of "diversity," I figured I'd write a thread on immigration history and why country caps are, in fact, the product of a system designed to discriminate on the basis of national origin. 1/10
Many of the first immigrants to the new country were from northern/western Europe. Anti-Irish and anti-Catholic sentiments were high. By the late 1800s, people from the rest of Europe and China had begun coming in. Resentment of the Irish, Italians, and Chinese grew. 2/10
It was in this context that America's *first* federal immigration law was signed into law: the Chinese Exclusion Act of 1882, which explicitly barred almost all immigration from China. This ban was extended more broadly to other parts of Asia in 1917. 3/10

1/ The Fairness of High-Skilled Immigrants Act, 2019, or #HR1044/#S386, which would've removed country caps on green cards in the US for Indian and Chinese nationals, particularly bringing the wait time for Indians from 150yrs to ~10...
2/ ... was blocked in the Senate by Sen. Dave Perdue after bipartisan support in the House. If you were Indian and moved to the US for an undergraduate degree in 2001, you'd be 36, have spent half your life in the country and not have a green card.
3/ You might be married with kids but if you lose your job, you might have to leave your family after paying for a college degree and 14yrs worth of usually fairly high taxes. Isn't that absurd?
