Folks: SDNY will not indict Trump unless Bill Barr approves. SDNY going rogue is a fantasy.
Barr would approve an indictment of Trump only if he felt it was both constitutional and a good idea.
For Barr to find it constitutional, he would have to overrule two opinions of DOJ’s Office of Legal Counsel (which he headed in 1989-90) that concluded otherwise (in 1973 and 2000).
For what it’s worth, Barr said at his confirmation hearing that he sees “no reason to change” those OLC opinions (h/t @mls1776). talkingpointsmemo.com/livewire/barr-…
Finally, even if Barr concluded it was constitutional to indict Trump, he might think it unwise — that’s exactly what Ken Starr concluded re Clinton. nytimes.com/2017/07/22/us/…
