Folks: SDNY will not indict Trump unless Bill Barr approves. SDNY going rogue is a fantasy.
Barr would approve an indictment of Trump only if he felt it was both constitutional and a good idea.
For Barr to find it constitutional, he would have to overrule two opinions of DOJ’s Office of Legal Counsel (which he headed in 1989-90) that concluded otherwise (in 1973 and 2000).
For what it’s worth, Barr said at his confirmation hearing that he sees “no reason to change” those OLC opinions (h/t @mls1776). talkingpointsmemo.com/livewire/barr-…
Finally, even if Barr concluded it was constitutional to indict Trump, he might think it unwise — that’s exactly what Ken Starr concluded re Clinton. nytimes.com/2017/07/22/us/…

Folks, if you’re asking lawmakers about Trump springing Manafort ask about COMMUTATIONS not just PARDONS. Trump could reward Manafort just by commuting — i.e. reducing — his sentence dramatically. No pardon needed! 1/
Trump has done this before — most notably in the case that Kim Kardashian West championed. He freed Alice Johnson without pardoning her. 2/ nytimes.com/2018/06/06/us/…
Manafort obviously would be delighted if Trump lopped off a big chunk of his sentence. Trump could even reduce the sentence to time served without needing to issue a pardon. 3/

Last night’s stories didn’t explain why Trump didn’t give Kushner an SCI clearance. Was he afraid CIA would leak his role? Was he conned by staff into thinking he lacked authority to do it? 2/
Perhaps then-CIA Pompeo, who seems to be the only national security appointee whom Trump actually likes, warned him not to do it? ¯\_(ツ)_/¯ Whatever the reason, it’s 🍌🍌🍌 that Kushner lacks such clearance but is hobnobbing with MbS, among much else. 3/

Many people say that Mueller’s report should be made public because Trump isn’t indictable as a sitting president. But this is an incomplete argument -- for one thing, that might not be why Mueller doesn’t indict him. 1/
Mueller might believe that – even if he *could* indict Trump – the nation would be better served if the president wasn’t indicted. This is what Ken Starr concluded with regard to Clinton. 2/ nytimes.com/2017/07/22/us/…
Or Mueller might simply conclude that he can’t prove beyond a reasonable doubt that Trump committed a crime within Mueller’s purview. That's very different from concluding “Trump did nothing wrong” or even (due to the burden of proof) “Trump didn’t commit a crime.” 3/

Congress won't Impeach til they've got the Senate votes but GOP is sticking HARD to the party line
