1/ Mea culpa: A couple of days back I tweeted a short thread premised on the assumption that the signatures on DOJ's ACA notice on Monday reflected an inability to find any career DOJ lawyers who'd agree to make the arguments. I should have reviewed the docket first:
2/ Hunt, Shumate & Totaro have been the lawyers on DOJ filings all along, back to January. So Monday's filing doesn't say anything one way or the other about the willingness of other DOJ lawyers to participate. It remains an awful, indefensible set of arguments on their merits.
3/ But I apologize for speculating beyond that based upon my mistaken assumption that there was something unorthodox about the signature line. Accordingly, I've deleted those posts. Sorry for leaving any misimpressions.
