To me, this vindictive attitude towards accused in #TabrezKillersShielded propaganda is nothing but hate mentality against dalits. Those seeking death of accused are real lynch mobs. Let me explain why. 1/n
1. Police has not let off the accused in the case. Police has said the accused cannot be charged with murder. This is the truth. To prove murder, one must prove that death happened due to attack. And more importantly, attack had intention of murder.
2/n
2. In Tabrez case, both points are dubious. One, it is difficult to medically prove that cardiac arrest was due to injuries sustained. Unlike in @sherryontopp case or Meerut case where victim died of head injuries, or Amethi case, injuries dont show unambiguous correlation. 3/n
3. Further, in Tabrez case, it is too fantastic a theory that dalit mob wanted to kill him, but in a way that he dies of injuries after 5 days! These methods are known only in Kungfu fiction. Also same mob who wanted to kill him, handed him to police instead! 4/n
4. Clearly, poor dalits were fed of thefts and that a thief (repeat offender) came from long distance to steal their motorbike (a precious asset for poor). They knew law is too slack to give justice. So wanted to punish the thief before handing over to police. 5/n
Now, either he was accidentally beaten bit hard, or got scared that more of his crimes would surface. Or was too weak. Or was beaten again in custody. For reasons, not clearly attributable to any one of these, he died of cardiac arrest. 6/n
From law's perspective, a crime happened. Few dalits took law in hand to beat a person. Person died. Same charges as those that apply to @sherryontopp were applied. But it is not murder as no act of mob shows that they had any intent to murder. Hence it is IPC 304, not 302. 7/n
