No racial disparities in Seattle? No criminalization of health issues, poverty, addiction, mental health, homelessness? No bail? No laws preventing people in the system from succeeding once out? No solitary confinement? No mandatory minimums? No guilty pleas? Sounds like Utopia.

I mean, Omaha. I really wanted to believe you that the problems we see in NY & our criminal courts was just isolated to this side of the coast. But what I'm learning with simple Google searches is making me question whether I should just "focus on NY."

In criminal court arraignments in Brooklyn. When public defenders meet people we represent, prosecution formally charges, judge determines bail & whether to issue orders of protection. Today, I’m going to focus on the pain the government inflicts everyday based on hearsay alone.
Its only 9:50am & already seen 6 people hauled, back cuffed, before a judge. Stopped, searched, arrested, cuffed, transported, fingerprinted, held in squalid conditions overnight, caged, retinas scanned, charged w/ crimes, facing 1 year on Rikers.

All entirely based on hearsay.
Prosecution has requested 6 orders of protection this morning. Btwn girlfriend & boyfriend, neighbors, parent & children. On one occasion, prosecutor had to ask defense the precise relationship. Orders mean: forced separation, eviction, homelessness.

All based on hearsay alone.

Things the government does based on hearsay (a non-exhaustive list):

Stop.
Search.
Surveil.
Eavesdrop.
Frisk.
Arrest.
Charge misdemeanors.
Charge felonies.
Secure search & arrest warrants. Detain pretrial on unaffordable bail.
Issue orders of protection.
Subpoena.
Indict.
Enhance sentences.
Revoke pretrial release.
Revoke probation.
Deny parole.

Good point. In my defense, @nycsouthpaw, I saw this thread as an educational opportunity about how much pain can be inflicted based on hearsay.

But yes, a non hearsay admission would justify all the above. Plus a conviction.

#dragqueenstoryhour is a non-profit of over 35 chapters across the US and made up of volunteers who are trained and given background checks. The goal of the group is to create a space of tolerance and acceptance that they hope will translate into future generations making change.
One volunteer said of the group: “This year we celebrated 50 years of Pride, and knowing that there [are] so many drag queens, to many transgenders, so many lesbians, so many gay people getting killed…just for being who they are…we don’t want that to continue.”

Every year over 600,000 enter prison gates but people go to jail 10.6M X each year.Jail churn is particularly high as most ppl in jails haven’t been convicted. Some will make bail within hours or days while many others are too poor to make bail &remain behind bars until trial./3

Not addressed here, & rarely ever addressed, when people don’t get arrested for low level offenses, they are still given summonses.

Is that better? Yes - they don’t spend the night in jail.

But it does absolutely nothing to address racial disparities.

We’ve had this wholesale transference of people from criminal court to summons court. So arrest statistics are down (but as this article points out, racial disparities remain) & the process has just become less visible.

In many ways, it’s a deliberate manipulation.
People issued summonses are still charged with the same offenses as if they were arrested - and in some cases this will be a misdemeanor.

That’s serious, but people, because they got a ticket, may not appreciate that and may be more likely to plead guilty.

This is no longer about compassion or helping people, it’s about cold hard cash. These organizations are working not to transition people, but to keep them IN the camps.
