Recall that the matter was set for the hearing of the defendant’s (Fatoyinbo’s team) Notice of Preliminary Objection on 16th October 2019. I’m still in shock about how the case file went missing in court at the last adjourned date. Do they think they can kill this matter?! 🤔
The Busola Dakolo matter did come up on Wednesday, the 16th day of October 2019 before the presiding Judge, His Lordship Honourable Justice A. O. Musa & the matter was called by the Court’s Clerk, there was a shocking drama in the court as the case file was not before the Court.
The court admitted the entire case file was missing, which resulted into a mild drama as counsel on both sides as well as the gallery were visibly tensed. The Court then immediately instructed the Court Registrar & Clerks to go & search for the file & then stood the matter down.
Franklin Olufemi from the law firm of Pelumi Olajengbesi & Co. representing Busola Dakolo joined the 3 Clerks & Registrar in the search, while Alex Izinyon II, from Alex Izinyon SAN law firm representing the Fatoyinbo equally join the Registrar & Clerks to scan through...

One of the clerks of the court had to call another registrar of the court who was absent to inform him of the situation and he informed the caller, who relayed the same that the file is with one Usman who is just a court bailiff.

The said Usman initially denied having the file as he has no business keeping files but on further prompting, he agreed to search his table in the open office & lo and behold, he suddenly said he now recalled where the file was and pulled the file out of his drawer!
I am still bewildered that the Judge did not sanction anyone for this. Corruption is perpetuated because the purveyors of impunity know they will get away with it. Corruption need not scare us much due to excessive exposure but the comfort of those doing nothing about it.

In the end, the court visited the hearing and gave room for both sides of the argument. Suffice to say this went well and we await the ruling on the positions. Stay tuned. Justice will be served. We are in this for the long haul. #EndRapeCulture
While we are at that can someone beg @PoliceNG to release the report of their investigation publicly? I still want to believe that the Police will do the right thing having botched a whole@lot in the process already. Make a believer of us all. We are waiting!
