There are many distinguished constitutional scholars and experts on Twitter. I'm not one of them. But on question of Senate calling WH witnesses to testify: Many of you think that will be the magic event that changes the game on impeachment. 1/3
But if I understand correctly, if the matter went to court and WH lost, the witness would be compelled to show up but could still refuse to answer at least some questions based on executive privilege. Might not be as satisfying as some hope. 2/3
Isn't that what the lower-court McGahn ruling said? Is there some reason a higher court would reject that? 3/4
