In state and federal appeals, there are often 70+ pages of briefing to read, accompanied by a record of hundreds of pages

And yet oral argument usually takes 30 minutes - TOTAL - if it's granted at all

Why?

Everyone reads the briefs!
In the briefs, the legal arguments are made formally, with citations

Most cases can be resolved on the briefs

Oral argument hones in on areas of disagreement and ambiguity, where the judges and the lawyers go back and forth to get to the bottom of a tricky issue
But you know what judges hate?

When lawyers just re-read their briefs to them

Because it treats judges like morons, and there's nothing judges hate more than having their time wasted
In this case, the judges are Republican Senators

Adam Schiff and his team filed a 100+ page brief laying out their case

And now they are spending 24 HOURS OF TV TIME repeating what they said in the briefs

What a massive waste of time!
