Interesting speech by @MichelBarnier in Hannover last night, with a large focus on #Brexit.
A few quick points that are worth noting with an eye to current 'impasse'.

Even *with* the UK's current red lines, he expects a wide-ranging FTA that covers:
- Customs cooperation
- Voluntary regulatory cooperation to encourage *convergence*
- Open market for services
- Rules limiting technical barriers to trade
- Zero tariffs

In addition, EU aims for:
- Ambitious agmt re mvnt of people (e.g. MRQs, social security)
- UK participation in EU progs
- Socio-ec coop
- & given UK's 'geographic proximity’, level playing field on environmental & social standards.
Intention= minimise NI-specific solutions?

Barnier notes these are *political* as well as social & economic questions.

The answers given by the UK to these Qs will be key to ratification of any future deal (by national & European parliaments).

A timely reminder of need to build trust
& of Ireland's importance/power

Today UK govt published its unilateral 'commitments to Northern Ireland & its integral place in the UK'.
I'd read it not just as an effort to get unionists on board #WithdrawalAgmt but a nod towards post-Brexit governance.

It comes on the 2nd anniversary of the collapse of the NI Executive.
I really hope that isn’t a coincidence.
& if it isn't, it's a pointed reminder to those who claim to be concerned abt the representation of NI that they cd put more effort into getting Stormont up & running.

The DUP came out quickly to reject it, underwhelmed & unconvinced.
Others will be too, but we cdn’t expect detail or substance on commitments at this stage.
(Besides, perhaps it's a duty of politicians in NI to bring forward proposals re: enhancing representation of NI..?)

If you are looking for a workable alternative to the Protocol on NI/IRL in the #WithdrawalAgreement, & if you are worried about @BorderIrish & @BelfastAgmt, I'm afraid this isn't it.

Here's a thread that is as tight as possible.

First, don’t be fooled by the legalise & jargon.

It cannot be a serious legal text if it assumes that parties can simply “agree not to place physical infrastructure or introduce related checks and controls on the Irish border in any circumstances” (as per para 2).

2/
It is not in the gift of these parties to make such a guarantee without proper consideration of consequences for their international trade partners + responsibilities to their own consumers.

What this proposes in terms of 'Irish border measures' doesn't cut it (more anon.).

First, some general points I think are worth noting, mainly about how the UK is trying to frame it & what has changed in the Preamble to the #Protocol.

To the #backstop, which is now about avoiding north/south AND east/west barriers... at least at face value.
UK keen to emphasise its temporary nature & unlikely implementation.
Initial decision on whether it comes into force will have to be made by 1 July 2020 & by the UK.

Lot's of conflicting noise around. Firm predictions a mug's game.

So here's what I know, after chats with both sides 1/Thread
There are two opposing forces at work here:

On the positive side....a gathering political momentum for quick progress. This is shared jointly in London (which wants vote by Xmas) but also, EU sources say, by Tusk/Junker who are frankly bored with Brexit

But opposing this... /2
Is the equally audible notes of caution in last 24 hours from Barnier, Taoiseach Varadkar, Commission Hogan and others saying that the "betting" must be December.

At October EUCO there was also a sense from Macron/Merkel, I understand, that they could run to DEC.

#Brexit thoughts this AM. The draft Withdrawal Agreement has a Northern Ireland sub-committee to the Joint Committee and sounds like there's been progress on an arbitration panel for the governance of the treaty = forum to discuss exit from a temporary customs arrangement? (1)
ANOTHER reminder of what @MichelBarnier said about the UK-wide customs idea way back in July. Note the problems he said had to be solved to make it work. europa.eu/rapid/press-re… (2)

I find this @Telegraph story today the most bewildering story of #Brexit vs #NHS yet. Will Brexit solve staff shortages? @SteveBarclay says yes. The facts say otherwise. /thread.

The EU as a "rules-based system" guarantees frictionless trade between its members, and protects a legal order that can apply the same rules across national borders on consumer protection, the quality of the environment, food labelling and safety, third country products … 2/
The EU acting based on rules is not the same as being "rigid". Members, together w/ EP, can jointly adapt rules faced w/ new challenges: to regulate more, or less, or differently. But the prerogative of deciding on how the EU changes or reforms itself is for "members only". 3/
