Congress would need to pass a new law affirmatively banning this practice, not "change the law that does it."
Because Trump's strategy, when confronted about a policy he knows everyone finds morally reprehensible, is to lie that he somehow had his hand forced by some fictional thing Democrats did.
Trump went out of his way to kill it by executive action, and rejected two bipartisan deals to save it. But he kept saying "The Democrats won't fix DACA, the Democrats won't fix DACA." And eventually the media started asking, why won't Democrats fix DACA?
It doesn't have to make sense, he got away with it on DACA and thinks he can again.
