Instead of reverting to an actually humane policy, Trump is choosing one he knows will get shot down in court, which he will then hold up as proof of the false claim that “the law” required him to separate families.
When, inevitably, this happens, the response ought to be: No law requires a blanket policy of automatically locking these families up at all, and we have a variety of pretty effective ways to track people in the country pending legal proceedings.
We HAD an extremely effective case management system that allowed most families to be released and monitored pending hearings. We could easily revert to that. Trump decided he preferred to exercise his discretion to take a crueler approach. No law made him do that.
