There's an argument to be made that if UK is planning to breach its WTO obligations for a while in event of no deal (eg by imposing no duties/checks at Irish border), uncertainty around appeals process could work in its favour.

I would of course never make that argument.
For what it's worth, I have a list of things that the UK could do in event of no deal that would probably be technically in breach of its WTO commitments but could probably get away with for a while.
For eg- and this would be *very* against the rules - instead of unilaterally reducing/removing tariffs on all imports, the UK could probably get away with continuing to just zero-tariff imports from EU for a temporary period.

Just kicks the can of course, but there we go.
Again, not advising this. Just clarifying that my scepticism of "UK can't do x because the WTO says ..." and "the EU must do x because the WTO says" extends to every aspect of the Brexit debate.
