The central role the UK Supreme Court has played in the Brexit process is an indictment of the entire political system - wealthy individuals have resorted to an institution which is, by design, democratically unaccountable to advance their opposition to the UK leaving the EU 1/9
While it is to be welcomed that Boris Johnson and his cabals attempts at extending untrammelled executive power have been frustrated, it is the opposition, in particular the Labour Party, that should be leading the way on this, not the courts 2/9
The failure of Parliament to depose this government and force a general election has allowed Johnson paint himself as champion of the people, fighting the establishment (a perverse inversion of reality), and the anti-democrats on the Remain side have resorted to the courts 3/9
Socialists, and all on the left, should be under no illusions: the law and the courts are not neutral instruments of right, but service particular class and sectoral interests, as Danny Nicol argues here 4/9 ukconstitutionallaw.org/2019/09/25/dan…
The recent Supreme Court decision involved the courts in making a political intervention, and one which benefits particular interests, as Mike Wilkinson points out 5/9 verfassungsblog.de/a-constitution…
But the law and the courts are there to preserve the status quo, and will be used to frustrate any left wing government in the UK, indeed the darling of the liberal left, Lord Pannick, who argued for the applicants in the prorogation case, has already fired a warning shot 6/9
That if Labour attempted to pursue its policy of abolishing private schools and expropriating their resources (@AbolishEton) the courts would be used to frustrate and resist this 7/9 thetimes.co.uk/article/times-…
We know from historical experience, and recent examples around the world, that the law and courts are routinely used to undermine workers rights and struggles, and to discipline even moderately left wing governments, this is part of the reason the ECJ is central to the EU 8/9
As we fight to transform society, and resist the anti-democratic machinations of both Johnson and the anti-democrats on the Remain side, we have to remember that the law is not on our side, and the courts do not serve our interests 9/9
