2/ When I think of the pushback I and other lawyers got for saying that, yes, Sessions *did* perjure himself before Congress, it makes me mad. Because apparently the FBI was—the whole time—investigating exactly that, as any criminal attorney could have told anyone they should be.
3/ I'd advise people to be careful about assuming Sessions isn't a target because his lawyer says so. Mueller hasn't said so—and to be very clear, if Sessions is a cooperating witness in the Mueller probe, that may be the basis for Mueller temporarily shuttering a perjury probe.
4/ Per ABC, "It's unclear how actively federal authorities pursued the matter in the months before Sessions' interview with Mueller’s investigators. It's also unclear whether Mueller may still be pursuing other matters related to Sessions and statements he has made to Congress."
5/ So don't think Sessions is clear because his lawyer says so. He's paid to. In fact, Sessions may have earned a reprieve through cooperation or other consideration (e.g. non-interference with Rosenstein), and/or he may still be under investigation by Mueller over his testimony.
6/ ABC News confirms the FBI saw Sessions as a target—then passed its case on to Mueller, who interviewed Sessions. Afterward, Sessions' lawyer noted Sessions' cooperation and said he wasn't under investigation—which may be so, based on the cooperation. Now ABC says nobody knows.
